Første statusrapport om strategien til forenkling af de lovgivningsmæssige rammer
Resumé
Dette arbejdsdokument fra Kommissionens tjenestegrene er en direkte opfølgning af
Kommissionens meddelelse fra oktober 2005 "Gennemførelse af Fællesskabets
Lissabon-program: en strategi til forenkling af de lovgivningsmæssige rammer" [KOM(2005)
535]. Det ligger desuden i forlængelse af meddelelsen "En strategisk gennemgang af
programmet for bedre lovgivning i Den Europæiske Union".
En forenkling af EU-lovgivningen kan i høj grad være med til at forbedre de
lovgivningsmæssige rammer, skabe ajourførte og mere moderne retsregler og begrænse den
administrative byrde. Når der samtidig tages hensyn til udviklingen inden for teknologi, på
markederne og internationalt set, opnår man desuden, at den europæiske økonomi kommer til
at stå stærkere. Kommissionen anser derfor forenkling for at være et meget vigtigt politisk
punkt på dagsordenen for bedre lovgivning.
I overensstemmelse hermed gøres der i arbejdsdokumentet fra Kommissionens tjenestegrene
status over, hvor langt man er nået med gennemførelsen af den forenkling, der blev igangsat i
oktober 2005, ligesom dokumentet omhandler det igangværende arbejde og de helt nye
initiativer, som vil styrke det rullende forenklingsprogram for perioden 2006-2009. Et af de
vigtigste resultater af forenklingen er, at alle EU-lovgivningsområder gradvis bliver omfattet.
I arbejdsdokumentet gøres der også status over, hvor langt man er nået med kodifikationen af
EU-retten.
I denne første statusrapport beskrives endvidere succeskriterierne for at opfylde
forenklingsmålene, bl.a. faste procedurer, et forbedret interinstitutionelt samarbejde med
Europa-Parlament og Rådet i de afsluttende faser af lovgivningsarbejdet, forøget anvendelse
af selvregulering og samregulering samt forenkling på nationalt niveau, så det sikres, at
fordelene ved forenklingen på EU-niveau ikke forsvinder på grund af nye nationale regler
eller tekniske barrierer.

INDLEDNING
I overensstemmelse med de politiske prioriteringer i politikken for bedre lovgivning, der blev
fastsat i marts 2005, vedtog Kommissionen i oktober 2005 en ny strategi for forenkling af de
lovgivningsmæssige rammer

. Det overordnede mål med strategien er at forbedre kvaliteten
og effektiviteten af den gældende ret og at fjerne unødvendige byrder for de erhvervsdrivende
og dermed at bidrage til at opfylde målet om at forbedre den europæiske økonomis
konkurrenceevne.
Europa-Parlamentet

stillede sig overordnet positivt til Kommissionens program til forenkling
af den gældende EU-ret, og Det Europæiske Råd

anmodede Rådet om at prioritere
forenklingsforslag højt i hele lovgivningsproceduren. Samarbejdet med medlovgiverne er
vigtigt, hvis forenklingsforslagene skal føres ud i livet.
I forlængelse af meddelelsen "En strategisk gennemgang af programmet for bedre lovgivning
i Den Europæiske Union"

gøres der i dette arbejdsdokument fra Kommissionens
tjenestegrene for første gang, siden strategien blev iværksat i oktober 2005, status over
arbejdet. Der gøres også rede for den seneste udvikling med hensyn til at gennemføre målene
i forenklingsstrategien. Arbejdsdokumentet:

Kommissionens meddelelse "Gennemførelse af Fællesskabets Lissabon-program: en strategi
til forenkling af de lovgivningsmæssige rammer" KOM(2005) 535. Forenkling omfatter en
lang række foranstaltninger, herunder ophævelse, kodifikation, omarbejdning og ændring af
retsakter. Kodifikation er nærmere beskrevet i nærværende dokument under punkt 1.2 "Status
over kodifikationsarbejdet". Omarbejdning består i, at der vedtages en ny retsakt, der i én og
samme tekst samler både de indholdsmæssige ændringer, der foretages i en retsakt, og de
bestemmelser i den tidligere retsakt, der forbliver uændrede. Den nye retsakt træder i stedet
for og ophæver den tidligere retsakt.

Det ajourførte rullende program for perioden 2006-2009 indeholder de forenklingsinitiativer,
der er peget på i Kommissionens lovgivnings- og arbejdsprogram for 2007, og giver et
overblik over Kommissionens bestræbelser på at forenkle de nuværende lovgivningsmæssige
rammer i et flerårigt perspektiv. At forenklingsinitiativer indgår i Kommissionens
lovgivnings- og arbejdsprogram for 2007 for første gang, viser tydeligt, at
forenklingsstrategien prioriteres højt politisk.
Reguleringskulturen er under forandring. For første gang har Kommissionen tilpasset sine
arbejdsmetoder, prioriteringer og ressourcer til forenklingsmålene. Et af de vigtigste resultater
er, at alle politikområder gradvis bliver omfattet.
Det igangværende arbejde til begrænsning af de administrative byrder vil fremover indgå i
forenklingsarbejdet, som for sin del kommer til at bidrage til det fælles mål om at begrænse
omfanget af EU-retten og den nationale lovgivning med 25 % inden 2012, jf. "En strategisk
gennemgang af programmet for bedre lovgivning".
I overensstemmelse hermed vil resultaterne af de omfattende høringer af de berørte parter og
konsekvensanalyserne bidrage til at forbedre kvaliteten af Kommissionens nye forslag og
sætte lovgiverne bedre i stand til at skabe nogle lovgivningsmæssige rammer, som er i fuld
overensstemmelse med subsidiaritetsprincippet og i højere grad bidrager til konkurrenceevne,
innovation og vækst. Det forventes, at forenklingsarbejdet herved vil blive lettere fremover.
Der vil løbende blive udarbejdet statusrapporter.

1.1.
STATUS
Status over det rullende forenklingsprogram
I forenklingsstrategien fra oktober 2005 indgår en række forenklingsmetoder. Strategien
omfatter et treårigt rullende forenklingsprogram, hvor der i første omgang for perioden
2005-2008 opregnes omkring 100 initiativer omfattende 220 grundretsakter, som
Kommissionen har til hensigt at forenkle. Listen er blevet til efter omfattende høringer af
medlemsstaterne, virksomhederne og borgerne.
Det er vigtigt, at der løbende foretages en vurdering af den gældende EU-ret, og
Kommissionen har derfor nu peget på yderligere 43 initiativer med forenklingspotentiale for
perioden 2006-2009. Disse indgår i det ajourførte rullende program, som er anført i bilag 1.
Med programmet bekræftes Kommissionens vilje til at arbejde for at begrænse den
administrative byrde, som de lovgivningsmæssige rammer medfører, og til at ajourføre og
modernisere bestemmelserne under hensyn til udviklingen inden for teknologi, på markederne
og internationalt set.

1.1.1.
Fremskridt i Kommissionens regi

initiativer, der var blevet planlagt for 2005, er blevet afsluttet. For 2006 indgik
der i meddelelsen fra oktober 2005 hele 54 initiativer. 3 nye initiativer er kommet til, 1 er
blevet overført fra 2005, og 1 er blevet fremskyndet fra 2008. Af disse er 15 initiativer indtil
nu blevet vedtaget

. Derudover er det for 24 forenklingsforslag blevet bekræftet, at de kan
vedtages inden årets udgang. Disse fremgår af bilag 1. 15 udskydes til 2007/2008. Efter
indgående vurderinger og høringer af de berørte parter udgår 5 initiativer.
Kommissionen har indtil nu vedtaget 27 initiativer ud af 71 for 2005-2006, og over halvdelen
af programmet vil være vedtaget ved udgangen af 2006. Det rullende forenklingsprogram er
blevet afviklet i forskelligt tempo i 2006, alt efter hvor komplekst det pågældende område har
været, og er i nogle tilfælde bagud i forhold til tidsplanen, men nogle initiativer er blevet
vedtaget tidligere end oprindelig planlagt. De forsinkede initiativer er imidlertid næsten alle
bekræftet for 2007.
Det skal understreges, at dette program er langt det mest ambitiøse forenklingsprojekt,
Kommissionen nogen sinde har iværksat. Forenkling er en vanskelig opgave, når fordelene
for virksomheder og borgere skal opvejes mod indsatsen og omkostningerne i forbindelse
med indførelse af nye lovgivningsmæssige rammer. På nogle politikområder kan forenklingen
indebære lovgivningsmæssige reformer. For at overvinde den modstand mod forandringer,
som reformplaner medfører, er der ofte brug for mere tid til at dokumentere de overordnede
makroøkonomiske nettofordele, som de foreslåede ændringer kan medføre.
Desuden kan der ved konsekvensanalyser komme fokus på nye elementer af relevans for de
politiske beslutningstagere, når det drejer sig om at vælge den mest egnede politikløsning

Gennemførelsen af forenklingsprogrammet ændres i takt med resultaterne af disse
konsekvensanalyser.
Næsten alle de forenklingsforslag, som Kommissionen har forelagt, er til behandling i Rådet
og Europa-Parlamentet. Disse forslag fremgår af bilag 3.

De resterende to - forslagene om strålingsbeskyttelse og landbrugsprodukter og om
edb-reservationssystemer inden for luftfart - er blevet udskudt til henholdsvis 2006 og 2007.

Blandt eksempler på forsinkelser i forenklingsstrategien kan nævnes: a) Den oprindelig
planlagte ophævelse af lovgivningen om edb-reservationssystemer i luftfartssektoren er taget
op til fornyet vurdering, og alle yderligere foranstaltninger er blevet udsat, da der opstod
behov for at foretage yderligere analyser på baggrund af reaktionerne fra både de berørte
parter og Europa-Parlamentet. Helt i overensstemmelse med principperne for bedre lovgivning
besluttede Kommissionen at gennemføre en udvidet konsekvensanalyse for at foretage en
grundigere undersøgelse af de forskellige muligheder, herunder ophævelse eller delvis
liberalisering af de eksisterende bestemmelser, og at høre de berørte parter igen. b) Den
seneste internationale udvikling på energiområdet og den efterfølgende debat om
energisikkerhed foranledigede Kommissionen til at udsætte den planlagte revision af
bestemmelserne om olielagre foreløbig indtil 2008. Kommissionens fremtidige politik på dette
område vil i høj grad afhænge af resultatet af høringen om grønbogen om energipolitik, som
Kommissionen offentliggjorde i marts 2006.

Nedenstående eksempler på resultater af forenklingsprocessen viser, at en række områder af
betydning for virksomhederne og borgerne allerede er omfattet af Kommissionens
forenklingsprogram.
Eksempler på forslag vedtaget af Kommissionen:
Moderniseret toldkodeks og e-told

:
Omarbejdelse af Fællesskabets toldlovgivning og
indførelse af elektroniske systemer på europæisk plan til dataudveksling mellem offentlige
myndigheder og virksomheder. Der vil blive indført mere smidige og enkle toldprocedurer
og toldregler, toldsystemerne vil blive automatiseret og indbyrdes forbundet, og der vil
blive indført et mere snævert samarbejde mellem alle de myndigheder og organer, der er
involveret i handelen med varer inden for EU, og dette vil gavne den internationale handel.
Miljø

: modernisering af rammedirektivet om affald:
– Forenkling af affaldslovgivningen ved præcisering af definitionerne, enklere
bestemmelser og sammenlægning af direktiverne om farligt affald og spildolie.
– Forbedring af genbrugsmarkedet, idet der fastsættes miljøstandarder, hvoraf det
fremgår, hvornår genanvendt affald ikke længere betragtes som affald.
Arbejdstagernes frie bevægelighed

Modernisering af de gældende bestemmelser om koordineringen af de
nationale socialsikringsordninger.
Forenklede procedurer for forsikringstagerne og kortere sagsbehandlingstid for
de forskellige organer inden for social sikring (sygdom, arbejdsulykker,
erhvervssygdomme, invaliditet, alderdom, arbejdsløshed og familieydelser) i
forbindelse med behandling af forhold, der går på tværs af grænserne.
Fødevaretilsætningsstoffer

Forenkling af lovgivningen om fødevaretilsætningsstoffer ved at indføre én
retsakt, der omfatter principper, procedurer og godkendelse.
Forbedring af procedurerne for ajourføring af Fællesskabets liste over
godkendte fødevaretilsætningsstoffer.
Små og mellemstore virksomheder inden for lægemiddelsektoren

: Indførelse af en
forenklet ordning for mikrovirksomheder og små og mellemstore virksomheder, herunder
nedsatte gebyrer, mulighed for udsættelse med betaling af gebyrerne og administrativ og
juridisk bistand ved indgivelse af ansøgninger til Det Europæiske Lægemiddelagentur.

Betalingstjenester

: Indførelse af forenklede lovgivningsmæssige rammer for
betalingsservice for forbrugere og virksomheder. Forslaget indebærer en forenkling af
lovgivningen (tre direktiver og tre henstillinger bliver afløst af et enkelt sæt bestemmelser),
forenkling af de administrative procedurer for offentlige myndigheder (på EU-plan og på
nationalt plan) og forenkling af de administrative procedurer for private. Med forslaget
indføres der mere gennemsigtighed og klarere og mere koncise informationskrav for
brugere af betalingstjenester og forbrugerne.
Regnskabsregler

: Ændring af de gældende regnskabsregler. Medlemsstaterne får med de
nye regler videre rammer for at fritage selskaber fra visse oplysningskrav (ved at hæve
tærsklen for, hvornår oplysningskravet gælder). Dette vil medføre en administrativ
forenkling for mindre virksomheder.
Statistik over erhvervsstrukturer

: Med forslaget forenkles udarbejdelsen af
statistikkerne over erhvervsstrukturer, idet 15 obligatoriske variabler udgår (om FoU,
beskæftigelse, energi og finansiel leasing), mens en række andre variabler ikke længere
skal indsamles årligt, men med flere års mellemrum. Samtidig udgår de frivillige variabler.
Desuden er Eurostat ved at udvikle et program til omlægning af
erhvervsstrukturstatistikken, bl.a. ved at hjælpe medlemsstaterne med nye metoder, der kan
begrænse respondentbyrden væsentligt, f.eks. en mere intensiv anvendelse af
administrative data og automatisk elektronisk indberetning af virksomhedsregnskaber.
Lufttransportmarkedet

Hensigten
med
revisionen
af
den
tredje
lufttransportliberaliseringspakke er at gøre lovgivningen mere læservenlig, idet tre
gældende forordninger samles i én enkelt ny forordning. Der er også tale om en
modernisering og forenkling af de lovgivningsmæssige rammer, og samtidig sikres det, at
lovgivningen bliver anvendt ensartet i de forskellige medlemsstater. I forordningsforslaget
er der endvidere taget hensyn til potentielle konkurrenceforvridninger og -begrænsninger i
nogle dele af markedet. Dette forventes at give flere valgmuligheder for forbrugerne,
lavere takster og mere konkurrence.
1.1.2.
Igangværende arbejde
En række vigtige forenklingsinitiativer med relevans for konkurrenceevnen er blevet
bekræftet for 2006/2007/2008:
Landbrug:
Sammenlægning af de 21 fælles markedsordninger til én enkelt ordning,
hvorved der indføres enklere horisontale lovgivningsmæssige rammer og dermed et enkelt
sæt harmoniserede bestemmelser på de forskellige områder af markedspolitikken som
f.eks. intervention, privat oplagring, toldkontingenter ved import, eksportrestitutioner,
beskyttelsesforanstaltninger,
landbrugsprodukter,
statsstøtte,
meddelelser
og
dataindberetning.

Miljø:
Gennemgang af direktivet om integreret forebyggelse og bekæmpelse af forurening
og anden hertil knyttet lovgivning om emissioner fra industrien med henblik på at gøre det
klarere og mere konsistent (blandt andet med hensyn til rapporteringskravene) og at
strømline kravene.
Byggevaredirektivet
med henblik på at præcisere bestemmelserne i det og begrænse den
administrative byrde, særlig for små og mellemstore virksomheder, gennem mere
fleksibilitet ved formuleringen og anvendelsen af tekniske specifikationer, mere fleksible
certificeringsbestemmelser og fjernelse af hindringer for gennemførelsen, der hidtil har
hæmmet skabelsen af et egentligt indre marked for byggevarer.
Statistik:
Lempelse af kravene til de erhvervsdrivende, særlig små og mellemstore
virksomheder, vedrørende indberetning af statistik under hensyn til det igangværende
arbejde med at forbedre den statistiske styring i EU og det endelige resultat af de
igangværende pilotprojekter om måling og reduktion af den administrative byrde.
Mærkning af fødevarer og foder:
Vil gøre mærkningsbestemmelserne klarere og dermed
gøre det muligt for forbrugerne at foretage sikre, sunde og bæredygtige valg på et sagligt
grundlag. Moderniseringen vil også bidrage til et konkurrencefremmende markedsmiljø,
hvor de erhvervsdrivende effektivt kan udnytte mærkningen til at sælge deres produkter.
Forbrugerbeskyttelse:
Rationalisering
og
forenkling
af
hele
forbrugerbeskyttelseslovgivningen
med
det
formål
at
fjerne
eventuelle
uoverensstemmelser, overlapninger, hindringer for det indre marked og
konkurrenceforvridende faktorer.
Kosmetik:
Kosmetikdirektivet blev vedtaget for 30 år siden og er siden blevet ændret over
40 gange. Det er nødvendigt med en omarbejdning, så der skabes større overensstemmelse
og klarhed i teksten. Hermed begrænses de administrative omkostninger ved
gennemførelsen og forvaltningen af direktivet. Den gældende ordning, i henhold til hvilken
afprøvning på dyr gradvis skal forbydes, forbliver uændret.
Bogførings- og regnskabsstandarder:
Virksomhederne i EU får et ajourført sæt
regnskabsstandarder, idet de gældende forordninger

, der omfatter over 2 000 sider,
samles i en enkelt og brugervenlig forordning.
Reglerne om biler:
Forslaget om ændring af rammedirektivet om typegodkendelse af
motorkøretøjer vil, når det er blevet vedtaget, indebære:
At EF-direktiver afløses af FN/ECE-regulativer. Med denne forenkling
strømlines bestemmelserne, og overflødige krav forsvinder. Desuden vil den
hjælpe branchen som helhed til at fjerne ikke-toldmæssige hindringer for
handelen, og EU vil kunne bevare sin førende position som udvikler af
internationale standarder. Samtidig får branchen mulighed for hurtigere at
tilpasse sig tekniske fremskridt på internationalt plan.

Kommissionens forordninger om godkendelse af internationale regnskabsstandarder og
hermed forbundne fortolkninger.

At der i 25 EF-direktiver og FN/ECE-regulativer indføres de tekniske
bestemmelser, der er nødvendige for at give mulighed for prøvning i
producentregi og virtuel prøvning. Hermed bliver det muligt at forenkle
typegodkendelsesproceduren og at holde de lovgivningsmæssige rammer ajour
med den teknologiske udvikling. Virtuel prøvning og prøvning i producentregi
vil fremskynde produktudviklingen og begrænse omkostningerne for både
branchen og forbrugerne. Desuden har Kommissionen stillet forslag om en
generel bestemmelse i direktivet om godkendelse af motorkøretøjer, der skal
give producenterne mulighed for at fungere som prøvningslaboratorier,
forudsat at typegodkendelsesmyndigheden har anerkendt deres faglige
kvalifikationer.
Adgang til vejtransportmarkedet og vejtransporterhvervet:
Omarbejdning af fire
forordninger og et direktiv med henblik på at præcisere og forenkle reglerne om adgang til
erhvervet og markedet og med henblik på at lette håndhævelsen af dem. I omarbejdningen
indgår også bestemmelserne om cabotagekørsel inden for gods- og passagertransport.
Formålet med omarbejdningen er at give mulighed for en harmoniseret anvendelse og
omkostningseffektiv håndhævelse af reglerne, også i international sammenhæng, hvorved
man begrænser konkurrenceforvridning, beskytter etableringsretten og forbedrer
servicekvaliteten og trafiksikkerheden.
Konsolidering af forordningerne og direktiverne efter
den nye metode

Der
opnås
hermed
konsistente
definitioner,
forenklede
certificeringsprocedurer og et smidigt administrativt samarbejde, hvilket fremmer
afsætningen af produkterne, samtidig med at producenterne beskyttes mod produkter, der
ikke opfylder bestemmelserne.
1.1.3.
Nye initiativer til styrkelse af det rullende forenklingsprogram
På grundlag af det rullende program, der blev iværksat sidste år, styrker Kommissionen sin
forenklingsstrategi med 43

nye initiativer i perioden 2006-2009 med det formål:
at fremme innovation og begrænse den administrative byrde, der er forbundet med de
lovgivningsmæssige krav
at begrænse den samlede mængde gældende EU-ret og fremme overgangen til mere
fleksible regler.

Direktiver efter den nye metode: I disse direktiver fastsættes kun de væsentlige krav af almen
interesse, som produkterne skal opfylde, og der fastsættes således ikke detaljerede
produktspecifikke krav. Producenterne kan vælge forskellige tekniske løsninger og selv vælge,
hvordan de vil dokumentere, at disse løsninger opfylder kravene, f.eks. gennem
standardisering.
De 43 nye initiativer omfatter 3 nye initiativer i 2006, 28 i 2007, 11 i 2008 og 1 i 2009.

Som eksempler på nye vigtige initiativer kan nævnes:
Forenkling af reglerne om ændringer af betingelser i markedsføringstilladelser for
lægemidler.
Administrationen af disse regler lægger i øjeblikket beslag på over 60 % af
personaleressourcerne og de økonomiske ressourcer i de afdelinger i
medicinalvirksomhederne, der står for administration af markedsføringstilladelserne. I
nogle tilfælde kan denne byrde være til hinder for innovation, idet den hæmmer indførelse
af ændringer, som kunne være gavnlige for patienterne og samfundet. Procedurerne vil
blive gjort smidigere, så forordningerne om behandling af ændringer af betingelserne i
markedsføringstilladelserne bliver mere enkle, klarere og mere fleksible, uden at det går ud
over folkesundheden og dyresundheden.
Gensidig anerkendelse

EU-bestemmelser. Kommissionen er ved at udarbejde et forslag til retsakt om fjernelse af
de tekniske hindringer for varers frie bevægelighed inden for EU. I retsakten fastsættes
dels de nationale myndigheders rettigheder og pligter, dels rettighederne og pligterne for
virksomheder, der i en medlemsstat ønsker at sælge produkter, som fremstilles og/eller
markedsføres lovligt i en anden medlemsstat.
Præcisering af definitionen af
nye fødevarer
og sikkerhedsvurderingsproceduren for disse
samt strømlining af godkendelsesproceduren.
Forenkling af de administrative procedurer på
landbrugsområdet
gennem indførelse af en
række tekniske forenklinger. Der er blevet iværksat en rullende handlingsplan med henblik
på ændring af de retlige bestemmelser, som har umiddelbare konsekvenser for
landmændene, andre erhvervsdrivende og de nationale myndigheder. Ændringerne
vedrører f.eks. landmændenes forpligtelser til at stille dokumentation til rådighed,
medlemsstaternes kontrolforpligtelser, betingelserne for at modtage støtte osv.
Forenkling og forbedring af den
fælles fiskerpolitik
ved hjælp af retlig og administrativ
forenkling i overensstemmelse med den handlingsplan for 2006-2008, som Kommissionen
vedtog i 2005

. Handlingsplanen omfatter en række bestemmelser om forvaltning af og
kontrol med fiskeriaktiviteter. Formålet er bl.a. at gøre de lovgivningsmæssige rammer
mere brugervenlige og at begrænse den administrative byrde for fiskerne og dem, der skal
administrere bestemmelserne.
Revision af reglerne om
elektroniske kommunikationsnet og -tjenester.
Der vil blive
mindre behov for forhåndsregulering, og både fleksibiliteten og innovationsmulighederne
vil blive fremmet til gavn for både branchen og borgerne.
Forenkling af proceduren for indførelse af navne på nye fibre ved at lade
tekstilstofdirektiverne
afløse af en enkelt forordning. De kvantitative metoder til måling
af fiberindholdet vil desuden blive overført til standardiseringsproceduren.

Denne retsakt vil omfatte de forskellige gældende minimumskrav
vedrørende sundhed og sikkerhed, f.eks. bestemmelserne om manuel håndtering af byrder
og skærmarbejde.
Alle Kommissionens tjenestegrene vil senest i 2009 have gennemgået de gældende retsakter
på deres område for at kontrollere relevansen af deres retsakter, valget af lovgivningsteknik
og mulighederne for at anvende en af de forenklingsteknikker, der er indeholdt i
forenklingsstrategien fra oktober 2005. Man finder på denne måde frem til, hvor det er
nødvendigt og passende at sætte ind med nye forenklingsinitiativer og dermed en ajourføring
af det rullende program fremover.
1.2.
Status over kodifikationsarbejdet
Kodifikation er et vigtigt led i Europa-Kommissionens indsats for bedre lovgivning. Ved
kodifikation forstås, at bestemmelserne i en gældende retsakt og alle efterfølgende ændringer
til retsakten samles i én enkelt retsakt. Herved begrænses omfanget af EU-retten, og den
bliver mere gennemsigtig, mere brugervenlig og retligt mere entydig.
Det rullende kodifikationsprogram (jf. bilag 2) omfatter omkring 500 retsakter. I alt 52
retsakter er blevet kodificeret

og vedtaget og offentliggjort i EUT (38 kommissionsretsakter
og 14 retsakter udstedt af Europa-Parlamentet og Rådet). 33 retsakter er til behandling hos
den lovgivende myndighed, og 8 retsakter er til skriftlig procedure. I alt 85 retsakter er blevet
færdigbehandlet af Europa-Kommissionen.

For at nå målet om at afslutte kodifikationsprogrammet inden medio 2008 er der truffet
foranstaltninger til at indhente efterslæbet ved omsætningen af originalteksterne til de nye
EU-sprog. Efterslæbet skyldes, at der er opstået forsinkelser ved oversættelsen af de tekster,
der skal kodificeres på disse sprog.
Der er også truffet foranstaltninger til at stille et så stort antal kodificerede tekster som muligt
til rådighed på bulgarsk, rumænsk, irsk og maltesisk. Dette er gjort ved først og fremmest at
kodificere de retsakter, hvor de relevante oversættelser er færdige.
Derudover har man udarbejdet et program for vedtagelsen af de resterende retsakter, der skal
kodificeres. Formålet er at sikre, at processen er gennemsigtig, og særlig at tilskynde til, at der
laves så få nye ændringer som muligt til de retsakter, der skal kodificeres. Herved
"stabiliseres" den pågældende lovgivning, og forsinkelserne begrænses. Programmet er kun
vejledende, da kodifikationen kun kan gennemføres, hvis de retsakter, der skal kodificeres,
foreligger på alle sprog. Dette spørgsmål berører særlig bulgarsk og rumænsk. Desuden må
kodifikationen udsættes, når der planlægges nye ændringer til disse retsakter. Rækkefølgen af
retsakterne i programmet vil ændre sig i lyset af disse to faktorer.
Det skal også bemærkes, at den lovgivende myndigheds vedtagelse af de kodificerede
retsakter er underlagt bestemmelserne i den interinstitutionelle aftale om en hurtig
arbejdsmetode ved officiel kodifikation af lovtekster af 20. december 1994.
2.
SUCCESKRITERIER
De lovgivningsmæssige rammer for de europæiske virksomheder og borgere består af flere,
ofte uløseligt forbundne lag af retsakter og bestemmelser, som er udarbejdet på forskellige
niveauer (på internationalt plan
23
, EU-plan samt nationalt, regionalt og lokalt plan). Ingen af
de forskellige lovgivere kan egenhændigt forbedre kvaliteten af denne sammensatte
lovgivning på afgørende vis. En konkret forbedring af kvaliteten af de lovgivningsmæssige
rammer som helhed kræver en beslutsom, sammenhængende og koordineret indsats på alle
lovgivningsniveauer.
2.1.
2.1.1.
Faste procedurer for forenklingsarbejdet
Høring af alle parter
Både det oprindelige og det ajourførte rullende forenklingsprogram (2006-2009) er blevet
udviklet på grundlag af de berørte parters og medlemsstaternes høringsbidrag. Deres
erfaringer er uundværlige, når det drejer sig om at udarbejde et meningsfuldt
forenklingsprogram. Tilbundsgående høringer af de berørte parter, gennemgang af hele
politikområder, efterfølgende evaluering af retsakter og ekspertbedømmelser hjælper de
politiske beslutningstagere med at afklare, hvilke problemer der opstår i praksis. Denne
fremgangsmåde letter også de berørte parters efterfølgende accept af den foreslåede
foranstaltning.

blev der bebudet en række specifikke
initiativer:
Som anført i Kommissionens meddelelse om forenkling og bedre regulering inden for den
fælles landbrugspolitik er der blevet udarbejdet en handlingsplan, som blev forelagt på
konferencen "A simple CAP for Europe, a challenge for all" (En forenklet fælles
landbrugspolitik for EU - en udfordring for os alle), der fandt sted i oktober 2006. I denne
handlingsplan gøres der rede for 20 konkrete projekter vedrørende teknisk forenkling
(reduktion af byrder uden at ændre den tilgrundliggende politik), som skal gennemføres
inden 2007. Handlingsplanen markerer indledningen af en løbende forenklingsproces. De
berørte parter og medlemsstaterne opfordres derfor til at fremlægge yderligere forslag til
forenkling.
Handlingsplanen for 2006-2008 med henblik på at forenkle og forbedre den fælles
fiskeripolitik blev vedtaget af Kommissionen i 2005 med fuld opbakning fra EU-
institutionerne og de hørte berørte parter.
Den kommende meddelelse om reducering af indberetningsbyrden, forenkling og
fastsættelse af prioriterede mål inden for fællesskabsstatistikker. I denne meddelelse er der
fastlagt en strategi til yderligere reducering af virksomhedernes statistiske byrde ved at
forenkle statistikkravene inden for udvalgte prioriterede områder og fremme anvendelsen
af statistiske værktøjer og metoder, som vil gøre det lettere at opfylde de statistiske
forpligtelser. Kommissionen vil bl.a. foreslå et envejsrapporteringssystem for Intrastat-data
og et program for omstrukturering af erhvervsstatistikken og vil fortsat arbejde aktivt for at
forenkle det europæiske landbrugsstatistiske system.
Herudover er det i traktatens artikel 138 fastsat, at arbejdsmarkedets parter på fællesskabsplan
skal høres om EU-initiativer på det social- og arbejdsmarkedspolitiske område

.
I nogle tilfælde har Kommissionen taget sine oprindelige hensigter op til fornyet overvejelse
som følge af resultaterne af en høring. Det gælder f.eks. i forbindelse med revisionen af de
lovgivningen om selskabsret og ophavsret, hvor høringen har ført til yderligere initiativer:
Hvad angår selskabsretten agter Kommissionen inden udgangen af indeværende år at
iværksætte et omfattende initiativ til måling af de administrative omkostninger i
forbindelse med selskabsdirektiverne for sammen med medlemsstaterne at kortlægge
mulighederne for at reducere disse omkostninger. Resultaterne af dette projekt vil blive
forelagt i en meddelelse i anden halvdel af 2007.
Hvad angår ophavsretten førte revisionen til en række aktiviteter, herunder en evaluering af
direktivet om ophavsret fra 2001, hvorved der bl.a. blev kortlagt undtagelser fra
anvendelsen af direktivet. Resultaterne af dette projekt forventes at foreligge inden
sommeren 2007.

2.1.2.
Sektorspecifikke analyser
I sin foregående meddelelse påpegede Kommissionen behovet for en sektorspecifik tilgang til
forenkling for bedre at vurdere de lovgivningsmæssige rammers betydning for de enkelte
sektorers konkurrenceevne.
Dette arbejde er f.eks. gået i gang på området byggevarer. Det omfatter bl.a. en generel
analyse af de faktorer, der har betydning for bygge- og anlægssektorens konkurrenceevne,
samt specifikke tiltag med henblik på forenkling af direktivet om byggevarer (direktiv
89/106/EØF). Høringen af de berørte parter er i gang, og Kommissionen gennemgår i
øjeblikket deres indlæg.
Inden for motorkøretøjer har højniveaugruppen CARS 21 undersøgt de politikområder, der
har størst betydning for den europæiske bilindustris konkurrenceevne, og udarbejdet en række
anbefalinger.
Herudover foretages der i øjeblikket en undersøgelse af anvendelsen af principperne om bedre
lovgivning inden for rammerne af de nye fora, der er oprettet som opfølgning til meddelelsen
om industripolitikken

. Der er i f.eks. taskforcen for konkurrenceevnen i ikt-sektoren og som
led i den politiske dialog om maskinindustrien igangsat en screening af de forskellige
sektorer.
2.1.3.
Igangværende arbejde vedrørende administrative byrder
Som reaktion på konklusionerne fra Det Europæiske Råds møde i juni 2006 og som led i den
fornyede Lissabon-dagsorden med hensyn til konkurrenceevnen vil Kommissionen i
begyndelsen af 2007 iværksætte en storstilet handlingsplan til måling og reduktion af
administrative byrder, som den gældende lovgivning i EU medfører. Denne handlingsplan
skal bygge på erfaringerne i fire medlemsstater (Det Forenede Kongerige, Nederlandene,
Danmark og Tjekkiet), som allerede har fastsat reduktionsmål efter at have gennemført
omfattende basismålinger. I Kommissionens arbejdsdokument om måling af administrative
omkostninger og reduktion af administrative byrder i Den Europæiske Union

gøres der rede
for resultaterne af et pilotprojekt vedrørende administrative byrder, som blev gennemført i
2006, og i hvilket man har gennemgået sådanne erfaringer og anvendt dem som grundlag for
det videre arbejde. Det er meningen, at denne proces på mellemlang sigt skal sætte EU-
lovgiveren og medlemsstaterne i stand til på grundlag af kvantificerede data at kortlægge
prioriterede områder, hvor kan ske yderligere forenkling.
I den sammenhæng skal det bemærkes, at der i øjeblikket gennemføres en undersøgelse på
landbrugsområdet vedrørende landmændenes administrative byrder. Denne undersøgelse
vedrører gennemførelsen af reformen af den fælles landbrugspolitik i 2003 og de senere
ændringer heraf. De første resultater vil foreligge i 2007.

2.2.
Tæt samarbejde mellem EU-institutionerne
Når Kommissionen leverer forslag til retsakter af høj kvalitet, er det Rådets og Parlamentets
ansvar at færdiggøre forenklingsarbejdet.
22 forenklingsforslag, som Kommissionen har vedtaget, er i øjeblikket til behandling i Rådet
og Europa-Parlamentet (jf. bilag 3). 7 af disse forenklingsinitiativer stammer fra de tidligere
forenklingsprogrammer fra 2003

og er endnu ikke færdigbehandlet af lovgiveren. Bilag 3
indeholder en liste over endnu ikke vedtagne forslag, der bl.a. omfatter tekster af stor
betydning for erhvervslivet, f.eks. revision af det sjette momsdirektiv, modernisering af
toldkodeksen, revision af affaldslovgivningen, forenkling af typegodkendelsen af
motorkøretøjer, rationalisering af statistikkerne over erhvervsstrukturer og ophævelse af
kravene til varer i færdigpakninger. At regnskabsdirektivet

, der indeholder bestemmelser om
fritagelse af SMV'er, er blevet vedtaget, og at Rådet for nylig er nået til enighed om den
fælles holdning vedrørende varer i færdigpakninger, viser institutionernes fælles vilje til at
forenkle de lovgivningsmæssige rammer.
I april 2006 svarede Europa-Parlamentet på Kommissionens opfordring til at reagere på dens
meddelelse om en forenklingsstrategi fra oktober 2005. Parlamentsudvalgenes holdninger til
det flerårige forenklingsprogram er i høj grad sammenfaldende med Kommissionens
prioriteringer med hensyn til, hvad der skal forenkles.
I maj 2006 vedtog Europa-Parlamentet en række betænkninger om forskellige aspekter af
bedre lovgivning, herunder forenkling
30
. Europa-Parlamentet foreslår bl.a. at indføre en nyt
instrument, parallelt med kodifikation og omarbejdning
31
, for bestemte typer
forenklingsforslag, hvor det vil være en fordel med særligt tilpassede arbejdsmetoder og
hurtigere vedtagelse.
Ved den interinstitutionelle aftale om bedre lovgivning
32
, der trådte i kraft i december 2003,
blev der oprettet en platform til udvikling af samarbejdet mellem de tre institutioner. Den
Tekniske Gruppe på Højt Plan, der er ansvarlig for at følge op på gennemførelsen af den
interinstitutionelle aftale, har regelmæssigt holdt øje med de fremskridt, der sker med hensyn
til f.eks. koordinering og programmering af lovgivningsarbejdet, kvaliteten af lovgivningen
(navnlig konsekvensanalyser), gennemførelse og anvendelse af EU-lovgivningen og
forenkling. Det har vist sig at være vanskeligt for medlovgiverne at pege på konkrete tiltag,
der kan bidrage til prioritering af forenklingsopgaverne og fremskyndelse af
lovgivningsprocessen.

Den aftale, der blev indgået mellem institutionerne i december 2005, om en interinstitutionel
fælles indstilling til konsekvensanalyse

er et bevis på, at når der er politisk vilje til det, kan
den interinstitutionelle aftale om bedre lovgivning føre til konkrete forbedringer, for så vidt
angår gennemførelsen af bedre lovgivning på interinstitutionelt plan. Når den fælles
indstilling i 2008 tages op til fornyet overvejelse, forventes institutionerne at beslutte, at
medlemsstaternes initiativer inden for politisamarbejde og retligt samarbejde i kriminalsager
skal ledsages af konsekvensanalyser.
Kommissionen har meddelt, at den agter at lette den interinstitutionelle beslutningsproces ved
at forbedre programmeringen og synligheden af forenklingsinitiativer gennem:
medtagelse af forenklingsforslag i Kommissionens årlige lovgivnings- og arbejdsprogram,
hvilket allerede er sket i programmet for 2007
fuld udnyttelse af begrundelser til bedre at redegøre for, hvilke forenklingsmål der
forfølges i forslagene. I forenklingsforslag, der er underlagt en konsekvensanalyse, vil
Kommissionen også bestræbe sig på at vurdere virkningerne af forenklingen, herunder med
hensyn til administrative byrder
udvælgelse af forenklingsforslag, der kan anvendes i en pilotundersøgelse vedrørende
mulighederne for at indføre bedre interinstitutionelle arbejdsmetoder i forbindelse med
forenkling.
2.3.
Øget brug af samregulering og selvregulering
Samregulering og selvregulering er eksempler på værktøjer, der under særlige
omstændigheder kan bruges til at gennemføre politikmål med begrænset indgriben fra
lovgiverens side.
F.eks. samarbejder de europæiske standardiseringsorganer og Kommissionen i øjeblikket om
at foreslå nye standardiseringsinitiativer i servicesektoren, som skal fokusere specifikt på det
indre marked. Standarder gør det nemmere for brugerne at sammenligne produkter og priser,
hvilket styrker konkurrencen og øger handelen med tjenesteydelser i EU. Udarbejdelsen af en
handlingsplan for standardisering til fremme af industriens konkurrenceevne - efter en
omfattende høring - og godkendelsen af en beslutning om EF-finansiering vil sætte skub i
standardiseringsaktiviteterne.
Inden for selvregulering har arbejdsmarkedets parter på fællesskabsplan en særlig rolle at
spille, da de har mulighed for at indgå aftaler

, der gøres bindende ved et forslag til retsakt
eller gennemføres autonomt. Selvregulering er konsistent med Kommissionens politik til
fremme af virksomhedernes sociale ansvar (VSA). Frivillige initiativer, der gennemføres som
led i den europæiske alliance for VSA, kan tænkes at føre til nye aftaler om selvregulering.

Den "Overenskomst
om sundhedsbeskyttelse af medarbejdere gennem god håndtering og brug af
krystallinske silikater og produkter som indeholder det",
der blev underskrevet i april 2006, er et
vellykket eksempel på selvregulering. Det er en autonom aftale, hvori er angivet en række eksempler på
god praksis med henblik på at minimere arbejdstagernes eksponering for silikatstøv. Den vil efter alt at
dømme bidrage til overholdelsen af de forskellige nationale grænseværdier for erhvervsmæssig
eksponering. Denne aftale, der er forhandlet mellem arbejdsmarkedets parter fra de berørte brancher, er
den første multisektorielle autonome aftale, der er indgået som led i den europæiske sociale dialog.

Sådanne initiativer, der tages af EU-virksomheder i tæt samarbejde med de øvrige berørte
parter, vil sandsynligvis også bidrage til en langt større udbredelse af VSA-praksis i Europa
og den øvrige verden. Det Europæiske Økonomiske og Sociale Udvalg og Kommissionen har
for bedre at oplyse private aktører, der ønsker at indføre eller forbedre
selvreguleringsordninger, og myndigheder, der er ansvarlige for udformningen af
samreguleringsordninger, oprettet en database over næsten 100 EU-ordninger. Denne
database, der skal være klar til brug i november 2006, indeholder bl.a. oplysninger om de
typer problemer, der har ført til udvikling af EU-selvregulerings- eller
samreguleringsordninger, om, hvilke mål disse forfølger, og om organisatoriske aspekter. Det
vil dermed blive meget nemmere at kortlægge god og dårlig praksis.
2.4.
2.4.1.
Forenkling på nationalt plan
Forenklingen af EU-lovgivningen skal forplante sig til det nationale plan
Arbejdet med forenkling på EU-plan skal have fuld opbakning fra medlemsstaterne, så det
sikres, at fordelene ved enklere lovgivningsmæssige rammer på fællesskabsplan ikke
forsvinder på grund af nye nationale regler eller tekniske barrierer. Et stigende antal
medlemsstater følger allerede trop, men der fortsat er plads til forbedringer. Et eksempel
herpå er opretholdelsen af statistiske krav på nationalt plan, selv om EU-lovgivningen er
blevet forenklet.
Kommissionen har derfor i nogle nylige forslag om ophævelse af retsakter medtaget en
bestemmelse om gensidig anerkendelse for at undgå, at der opstår nye handelshindringer som
følge af ophævelsen af de pågældende EU-retsakter. Forslaget om varer i færdigpakninger
sigter f.eks. mod at forebygge handelshindringer, der skyldes opretholdelsen af nationale krav.
For at beslutningen om at ophæve EU-lovgivningen om sortering af råtræ kan få den tilsigtede
virkning, skal den ligeledes følges op på samme måde i hele EU. National lovgivning, der
henviser til direktivet, skal ændres i overensstemmelse hermed, og medlemsstaterne skal
sikre, at tekniske ændringer gennemføres hurtigt og klart.
Europæiske virksomheder, der ønsker at udøve virksomhed i en anden medlemsstat,
underlægges alt for ofte administrative (kontrol-)procedurer. I nogle tilfælde bidrager
traktatens bestemmelser til forenkling af transaktionerne i det indre marked. Kommissionen
gør sit til at reducere sådanne byrder ved at håndhæve EF-traktatens artikel 28 om frie
varebevægelser, navnlig ved at overvåge udkast til national lovgivning.
I 2007 vil Kommissionen tage fat på integreringen af markedet for forsvarsmateriel med det
formål at lette de uforholdsmæssigt store byrder, der hæmmer EU-virksomhedernes
konkurrenceevne på dette område. De årlige omkostninger i forbindelse med tilladelser til
import/eksport inden for EU af militærudstyr anslås nemlig til 238,90 mio. EUR for
virksomheder og myndigheder. I praksis gives der dog næsten aldrig afslag på anmodninger
om tilladelse

Undgåelse af overregulering
Når man undersøger de nationale bestemmelser til gennemførelse af fællesskabsdirektiver,
finder man mange eksempler på tekniske krav, mærkningskrav, frister,
godkendelsesprocedurer og andre administrative krav, som de nationale myndigheder har lagt
oven i EU-lovgivningen (overregulering). De lovgivningsmæssige rammer for EU's
virksomheder kan kun forbedres, hvis de initiativer, der tages på EU-plan, suppleres af
relevante tiltag på nationalt plan.
Dette bekræftes fra anden side, f.eks. af en undersøgelse

, der er foretaget for nylig for en
national sammenslutning af SMV'er. Ifølge denne undersøgelse kan en udvidelse af det
oprindelige
anvendelsesområde
for
direktiver
i
forbindelse
med
gennemførelsesforanstaltninger hæmme små virksomheders produktivitet betydeligt og
dermed fjerne penge fra vigtige kilder til vækst og beskæftigelse. Overregulering kan desuden
stille nationale virksomheder dårligt i konkurrencen med andre lande.
Dette støtter Kommissionens hensigt - som anført i meddelelsen fra oktober 2005 - om at
udnytte potentialet for forenkling bedre ved at anvende forordninger i stedet for direktiver, når
det er relevant. Direktiv 91/414/EØF er således blevet afløst af en forordning om
markedsføring af plantebeskyttelsesprodukter, hvilket er et konkret eksempel på dette skift i
reguleringspraksis.
2.4.3.
Nationale reformprogrammer
De fleste lovgivningskrav og gennemførelsesforanstaltninger opstår på nationalt plan.
De nationale reformprogrammer er en del af den nye styringsstruktur i strategien for vækst og
beskæftigelse (Lissabon-strategien). I disse programmer gøres der rede for politikkerne for
økonomisk reform på nationalt plan med udgangspunkt i EU's retningslinjer. De har derfor
stor betydning for forbedringen af erhvervsklimaet i EU. Alle medlemsstaterne har reageret på
retningslinjerne for bedre lovgivning og medtaget foranstaltninger til fremme af bedre
lovgivning i deres nationale reformprogrammer.
På nuværende stadium har ni medlemsstater iværksat forenklingsprogrammer med forskellige
ambitionsniveauer som led i disse nationale reformprogrammer. Det er imidlertid meget
vigtigt, at EU's forenklingsprogram suppleres af tiltag inden for forenkling i alle
medlemsstater og på alle lovgivningsniveauer. I den af Kommissionen udarbejdede note til
Udvalget for Økonomisk Politik om fremme af bedre lov
givning

og rapporten om
konkurrenceevnen 2006 finder man de vigtigste konklusioner vedrørende gennemførelsen af
bedre lovgivning på medlemsstatsplan samt en mere detaljeret beskrivelse af de fremskridt,
der er hidtil er opnået på dette område.

Eksempler på nationale initiativer:
Reduktion af administrative omkostninger: I 17 medlemsstater er man bevidst om
nødvendigheden af at undersøge, hvilke omkostninger der pålægges virksomhederne, og
disse medlemsstater har iværksat målingsaktiviteter. Nogle har fastsat kvantitative mål for
reduktion af administrative omkostninger (f.eks. 20 eller 25 % inden 2010). Initiativer til
støtte for dette projekt er f.eks. e-forvaltning, one-stop-shops

eller centrale
registreringskontorer, begrænsning af skatte- og afgiftslovgivningen, forenkling af
administrative procedurer i forbindelse med beskæftigelse og selvstændig virksomhed eller
initiativer på tværs af offentlige myndigheder.
E-forvaltning og ikt-løsninger til reducering af bureaukratiet i offentlige myndigheder:
oprettelse af portaler med lovgivning og formularer (forespørgsler, indberetningsværktøjer
osv.), øget udbud af bredbånd.
Gennemgang af lovgivning for at sikre, at målene stadig er gyldige: forenkling af
arbejdsretten, formidling af god reguleringspraksis i hele den offentlige sektor, cost-
benefit-analyse af lovgivningen, oprettelse af et forum for erhvervslovgivning, hvor berørte
parter drøfter de byrder, der pålægges virksomhederne, overordnede principper for god
lovgivning, herunder nødvendighed, proportionalitet, subsidiaritet, gennemsigtighed,
ansvarliggørelse, tilgængelighed og enkelhed.
Forenkling af forpligtelser, forvaltning og indsendelse af oplysninger i forbindelse med
beskatning, især i form af one-stop-shops for virksomheder, SMV'er og borgere samt
reform af selskabs- og kapitalindkomstskatten.
Forenkling af momsforpligtelser, f.eks. fjernelse af skattemæssige hindringer for aktiviteter
på tværs af grænserne ved at indføre bestemmelser, der tillader skattelettelser for bidrag til
pensionsordninger i EU-medlemsstaterne, hvilket vil komme både migranter og
grænseoverskridende tjenesteydere til gode.
Forbedring af gennemførelsen af lovgivningen om det indre marked for at kunne udnytte
dets fordele fuldt ud.
SMV'er: bedre adgang til finansiering, reducering af indberetningskrav, oprettelse af en
webbaseret one-stop-shop for nyetablerede SMV'er.

Udveksling af bedste praksis mellem medlemsstaterne og peer reviews har afgørende
betydning for forbedringen af de lovgivningsmæssige rammer. Kommissionen letter dette

3.
KONKLUSION
Vi ser nu de første resultater af denne forenklingsstrategi, der er kernen i initiativet om bedre
lovgivning.
Kommissionen er fast besluttet på at gå videre med arbejdet og indfri sine tilsagn om at
bidrage til stærke lovgivningsmæssige rammer gennem et udvidet og ambitiøst rullende
program.
For at vi kan nå vores fælles mål, skal Rådet og Europa-Parlamentet engagere sig yderligere
og føre forenklingsarbejdet videre til de afsluttende faser.
Medlemsstaterne skal også gøre deres del af arbejdet. De bør udveksle bedste praksis og
gennemføre forenklingsprogrammer.

Taskforcen for forenkling af erhvervsklimaet (BEST) blev oprettet i 1997 med deltagelse af
repræsentanter for erhvervslivet og de offentlige myndigheder i medlemsstaterne. BEST havde til
opgave at udarbejde en uafhængig rapport om metoder til forbedring af lovgivningen og fjernelse af
unødvendige hindringer for europæiske virksomheders udvikling, herunder især små og mellemstore
virksomheder (SMV'er). BEST-ekspertgruppen har kortlagt initiativer inden for bedste praksis (f.eks.
fremme af one-stop-shops, risikobaseret lovgivning), som er gennemført i forskellige lande, således at
andre kan tage ved lære af deres erfaringer. Risikobaseret lovgivning sigter mod at koncentrere
lovgivningen (og de omkostninger, der påløber for virksomhederne) om de aktiviteter, der er forbundet
med den største risiko for folkesundheden eller miljøet.

The purpose of this proposal is to recast legislation on cosmetics
products, as part of a more general simplification strategy concerning
goods.
The purpose of this proposal is to clarify the scope and the objectives of
the existing Directive and to simplify the implementing mechanisms,
ensuring proper functioning of the internal market for construction
products, while avoiding constraints and obligations, e.g. administrative
costs, which are disproportionate to the benefits to be expected.
This Directive has become obsolete. The applicable standard specified
in the Annex dates back to 1979. It is intended to broaden the scope of
Directive 93/42/EC on medical devices which currently only addresses
medical devices for human beings to veterinary devices.
The objectives is to improve the current legal framework related to
industrial emissions, and to streamline the interaction between the
various legislation, while not altering the underlying principles and the
level of ambition of the present legal framework.
As regards the scope of the present initiative, it includes reviewing the
Directive 96/61/EC concerning integrated pollution prevention and
control (IPPC) and related industrial emissions legislation (Directive
2001/80/EC on large combustion plants, Directive 2000/76/EC on the
incineration of waste, Directive 1999/13/EC on the use of organic

The purpose of the Fertiliser Regulation is to guarantee to the farmer
the nutrient content of the fertiliser. For this purpose, the technical
Annexes of the Regulation give detailed technical specifications of a
larger number of nutrient test methods. The objective of the
simplification is to:
- Replace 150 pages of the Annexes containing detailed descriptions of
text methods with standards
- Have therefore greater compliance with WTO by use of international
standards
