Assuch, its members are not entitlcd to POW status.- Although wc never recognized the Tahc3n as the legitimate Afghan govemmcnt.Afghanistan is a party to the Conyention, and the President has detcrmined that theTalibanare covered by the Conventioo. Under the terms ofthe Geneva Convention, howeve-r,theTaliban detainees do not qualify as POWs.
