I
NDLEDNING
I strategien til forenkling af de lovgivningsmæssige rammer
1
, der blev indført i oktober 2005,
var der opstillet et rullende program af forenklingsforanstaltninger, der skulle vedtages
mellem 2005 og 2008, og som havde til formål at forbedre kvaliteten og effektiviteten af den
gældende EU-ret og samtidig bibeholde dens vigtigste politikmål.
I denne anden statusrapport, der supplerer meddelelsen "Anden strategiske gennemgang af
programmet for bedre lovgivning i Den Europæiske Union"

, gøres der rede både kvantitativt
og kvalitativt for de allerede opnåede resultater. Herudover kortlægges de opgaver, der venter
EU's lovgivende myndighed, og der søges tilført ny fremdrift til forenklingsstrategien, som er
et væsentligt element i den overordnede politik for bedre lovgivning og strategien for vækst
og beskæftigelse i Den Europæiske Union.
Det fremgår desuden af denne rapport, at Kommissionen lever effektivt op til sine
forpligtelser i henhold til det rullende program.
Borgere og virksomheder har allerede set konkrete resultater og vil se flere, efterhånden som
det store antal initiativer, der er til behandling hos den lovgivende myndighed, vedtages.
Indsatsen koncentreres om projekter, der kan give de interesserede parter, f.eks. små og
mellemstore virksomheder (SMV'er) og individuelle iværksættere, som alt for ofte
konfronteres med urimelige lovgivningsmæssige krav, betragtelige fordele.
Kommissionen agter at gennemføre en fuldstændig screening af den gældende EU-ret,
hvorved den efterprøver, om de eksisterende instrumenter fortsat er nødvendige, at det er den
rette form for regulering, der er anvendt, og at de byrder, de medfører, er så lette som muligt i
forhold til de tilstræbte politikresultater. I den forbindelse vil der ydermere blive afdækket nye
initiativer, der kan indgå i det ajourførte rullende forenklingsprogram, som skal forelægges i
starten af 2009. For at gøre en reel forskel skal denne fremdrift opretholdes i den lovgivende
myndigheds næste mandatperiode.
Samtidig vil Kommissionen, hver gang der opstår en mulighed for at forbedre
virksomhedernes vilkår - uden at berøre de tilgrundliggende politikmål eller stille forslag til
andre betydelige ændringer af de lovgivningsmæssige rammer - gøre brug af proceduren for
hurtige tiltag

, der medvirker til at reducere de administrative byrder i EU med 25 %

, som er
målet for 2012. Det omfattende projekt, Kommissionen har iværksat med henblik på at
kortlægge og måle administrative byrder på prioriterede områder, vil også sætte skub i
forenklingsprogrammet.

TATUS OVER DET RULLENDE FORENKLINGSPROGRAM
Oversigt
I forenklingsstrategien fra oktober 2005 blev der i første omgang peget på ca. 100 initiativer,
der skulle indgå i det rullende program i perioden 2005-2008. I november 2006 blev 43 nye
initiativer tilføjet

, og i oktober 2007 yderligere 16

, hvorved forenklingsarbejdet kom til at
omfatte alle politikområder og tidsplanen blev forlænget til 2009. I forbindelse med
programmet gøres der brug af lovgivningsteknikker såsom ophævelse, kodifikation og
omarbejdning

Tidsplanen for gennemførelsen af det rullende program overholdes i det store og hele. Indtil
nu har Kommissionen vedtaget over halvdelen af det ajourførte program for 2005-2009.
Kommissionen har færdigbehandlet 80 % af de initiativer, der efter planen skulle vedtages i
2007.
Indtil nu har Kommissionen vedtaget 91 forslag, heraf 24 såkaldt autonome retsakter vedtaget
efter udvalgsproceduren, 16 vedtaget af den lovgivende myndighed, 44, som fortsat er til
behandling hos den lovgivende myndighed, og 7, som enten er revisioner, som ikke har
krævet lovgivningstiltag, eller flere initiativer samlet til ét.
Alt i alt har Kommissionen siden oktober 2005 allerede fremsat forslag om ophævelse,
ændring eller afløsning af ca. 400 retsakter. Som følge heraf vil ca. 300 retsakter svarende til
ca. 5 000 sider i EU-Tidende udgå af EU's lovsamling. Herudover har Kommissionen, siden
den tiltrådte, sørget for, at ca. 2 500 forældede retsakter enten er udgået af den gældende EU-
ret eller er genstand for forslag herom.
2.2.
Lovgivning, som allerede er vedtaget
Gennemførelsen af strategien til forenkling af de lovgivningsmæssige rammer har allerede
givet virksomheder og borgere reelle fordele.
2.2.1.
Retsakter vedtaget af Kommissionen
Indtil videre er 24 forenklingsinitiativer blevet vedtaget af Kommissionen som autonome
retsakter efter udvalgsproceduren (bilag 4). For eksempel:
I 2005 vedtog Kommissionen en forordning, hvorved der er fastsat nedsatte gebyrer og
indført en ordning for administrativ bistand til små og mellemstore virksomheder, der
registrerer
lægemidler.
Forordningen indeholder bestemmelser om en nedsættelse på 90 %
af gebyrerne for videnskabelig rådgivning for SMV'er, nedsatte gebyrer for SMV'er i
forbindelse med ansøgninger om markedsføringstilladelser samt juridisk bistand for
SMV'er. Disse muligheder anvendes allerede i udstrakt grad af SMV'er, som er aktive på
dette område.
Bestemmelserne om
bevis for indførsel
til tredjelande (i forbindelse med
differentieret
eksportrestitution
for visse landbrugsprodukter) er blevet ændret således, at eksportører,
der ansøger om eksportrestitutioner, kan anvende containerskibes elektroniske "tracking
and tracing"-oplysninger i stedet for almindelige tolddokumenter (som er vanskelige at
opnå i visse lande).

Kommissionen har allerede vedtaget en henstilling vedrørende
elektroniske
kommunikationsmarkeder,
der hovedsagelig drejer sig om regulering på engrosniveau,
og som har reduceret antallet af markeder, der er underlagt forhåndsregulering, fra 18 til 7.
Det anslås, at de administrative omkostninger som følge heraf er blevet reduceret med ca.
25-30 % for fastnetoperatører og ca. 30-40 % for nationale tilsynsmyndigheder.
Forenklede markedsanalyseprocedurer vil betyde yderligere besparelser for de nationale
tilsynsmyndigheder.
2.2.2.
Retsakter vedtaget af den lovgivende myndighed
Hovedparten af programmet skal vedtages af den lovgivende myndighed, typisk efter den
fælles beslutningsprocedure. Indtil i dag er 16 forenklingsinitiativer fra det rullende program
for 2005-2009 blevet vedtaget (bilag 5), f.eks.:
På landbrugsområdet har den lovgivende myndighed vedtaget omarbejdningen af
21 fælles
markedsordninger til en enkelt ordning
for at effektivisere og forenkle den fælles
landbrugspolitik til fælles gavn for landbrugere, myndigheder og virksomheder, der
arbejder med landbrugsprodukter. Indførelsen af en enkelt fælles markedsordning vil
reducere lovgivningen på landbrugsområdet, gøre den mere gennemsigtig og gøre
politikken mere tilgængelig. Herved ophæves henved 50 retsakter udstedt af Rådet, og over
650 artikler i de nuværende forordninger erstattes af ca. 200 artikler, der skaber et meget
enklere overordnet regelværk uden at ændre de tilgrundliggende politikker.
Direktivet om klageprocedurer i forbindelse med
offentlige kontrakter.
I 2003 blev denne
sektors økonomiske betydning anslået til 1 500 mia. EUR, svarende til 16,3 % af BNP i
EU-15. Det nye direktiv forbedrer de nationale klageprocedurer, som virksomhederne kan
benytte, hvis de finder, at en offentlig myndighed har tildelt en kontrakt uretfærdigt. Med
direktivet indføres navnlig en obligatorisk standstill-periode mellem meddelelsen om
tildelingsbeslutningen og undertegnelsen af kontrakten for at give tilbudsgiverne tid til at
undersøge beslutningen og vurdere, om de vil indlede en klageprocedure. Direktivet
indeholder supplerende bestemmelser, der skal sikre dets effektivitet. Indførelsen af disse
nye rettigheder og procedurer for afviste tilbudsgivere i samtlige 27 medlemsstater har
afgørende betydning for at sikre, at kontrakterne i sidste ende tildeles den virksomhed, der
har afgivet det bedste tilbud, og dermed for at opbygge tillid hos virksomhederne og i
offentligheden til, at udbudsprocedurerne er retfærdige. Forenklingstiltagene er bl.a.
ophævelsen af de nuværende ordninger for forlig og attestering, som ikke har vakt reel
interesse hos virksomhederne og ikke bliver anvendt.
Direktivet om
betalingstjenester
bidrager til at skabe et "fælles betalingsområde" i EU,
som kan betyde besparelser for EU's økonomi på op til 28 mia. EUR om året. Formålet er
ar gøre elektronisk betaling i EU – med kreditkort, betalingskort, kredittransaktion, direkte
debitering eller andre midler – lige så let, billig og sikker, som indenlandske betalinger er
det i dag. Direktivet sikrer lige og åben adgang til betalingsmarkeder og forbedrer og
ensretter forbrugerbeskyttelsen. Der opnås forenkling gennem en harmonisering af
markedsadgangskravene, ved at man undgår den opsplittende virkning af forskellige
oplysningskrav i medlemsstaterne og EU, og gennem en harmonisering ud fra sikkerheds-
og effektivitetshensyn af brugernes og udbydernes grundlæggende rettigheder og
forpligtelser. Et mere effektivt og konkurrencedygtigt betalingsmarked betyder også, at
europæerne skal betale mindre for grundlæggende banktjenester, som i gennemsnit koster
mellem lige fra 34 EUR til hele 252 EUR om året i EU.

Ved ophævelsen af de fleste eksisterende krav til varer i
færdigpakninger
er
medlemsstaternes og EU's bestemmelser om ca. 70 forbrugerprodukter blevet fjernet.
Virksomhederne har nu større råderum til at imødekomme forbrugernes behov.
toldområdet
har den lovgivende myndighed vedtaget afgørelsen om e-told, hvorved
der vil blive oprettet et elektronisk system i EU for dataudveksling mellem de offentlige
myndigheder og virksomhederne. Mere effektive toldprocedurer, der fungerer ved hjælp af
automatiserede og indbyrdes forbundne toldsystemer, vil sætte yderligere skub i den
internationale handel. Når det bliver fuldstændig operationelt, skulle det integrerede system
føre til besparelser for virksomhederne på 2,5 mia. EUR om året, hvilket mere end opvejer
Kommissionens og medlemsstaternes investering på 40-50 mio. EUR om året. Den
moderniserede toldkodeks, der udarbejdes på grundlag af en gennemgang af EU's
toldlovgivning, forventes vedtaget i 2008.
2.3.
Forslag, som er til behandling hos den lovgivende myndighed
Omkring 44 forenklingsforslag er i øjeblikket til behandling hos den lovgivende myndighed,
heriblandt en række vigtige forslag, hvis vedtagelse vil kunne forenkle de
lovgivningsmæssige rammer yderligere:
Den banebrydende revision af EU's forsikringsret (Solvens
II)
vil forbedre
forsikringstagerbeskyttelsen i hele EU ved hjælp af mere ensartede og risikofølsomme
solvenskrav til forsikringsselskaber. Solvens II vil fremme bedre risikostyring, forsvarlig
prisfastsættelse og øget tilsyn og vil dermed styrke forbrugertilliden. Solvens II vil også
øge konkurrencen (specielt på områder med stor detailomsætning som f.eks. bil- og
boligforsikring), presse nogle forsikringspriser ned, fremme produktinnovation og øge
europæiske forsikringsselskabers internationale konkurrenceevne. Endelig bliver de
lovgivningsmæssige rammer mere gennemsigtige og brugervenlige, når et enkelt direktiv
træder i stedet for den nuværende mosaik af bestemmelser fordelt på 14 forskellige
direktiver.
Adfærdskodeksen for edb-reservationssystemer
blev oprindeligt udarbejdet for et
marked, der har udviklet sig betydeligt, idet luftfartsselskaberne har trukket sig ud af
arbejdet med reservationer og der stadig hyppigere reserveres over internettet. Markedet er
nu modent til mere konkurrence. Kommissionen foreslår, at markedskræfterne får mere
spillerum til at tackle de urimeligt høje reservationsgebyrer, som luftfartsselskaber og
passagerer må betale. Øget konkurrence vil forbedre kvaliteten af de udbudte
tjenesteydelser og reducere salgsomkostningerne i luftfartssektoren: Reservationsgebyrerne
forventes således at falde i de enkelte rejsesegmenter med mellem 0,7 og 0,9 EUR,
hvorved de samlede omkostninger reduceres med 190-240 mio. EUR om året.
Ændringerne af bestemmelserne om
elektroniske kommunikationsnet og -tjenester
har
til formål at sikre effektiv konkurrence, fremme investeringer, konsolidere det indre
marked og styrke forbrugernes interesser. Der slås til lyd for en væsentlig begrænsning af
reguleringen i tilfælde, hvor der er en klar tendens til konkurrence. I en uafhængig cost-
benefit-analyse vedrørende den foreslåede Myndighed for Markedet for Elektronisk
Kommunikation anslås de potentielle økonomiske gevinster at beløbe sig til over 10-30
gange driftsomkostningerne (dvs. 250-800 mio. EUR) som følge af mindre retsusikkerhed
og hurtigere bilæggelse af tvister. For frekvensafhængige tjenesteydere fører ændringerne
til mere fleksibilitet, forretningsomkostningerne reduceres, og hindringerne for adgang til
markedet for nye virksomheder fjernes. Resultatet for forbrugerne vil være flere
valgmuligheder og lavere priser for disse tjenesteydelser.

Et nyt direktiv om
indlandstransport af farligt gods
betyder, at alle tre former for
indlandstransport (vej, jernbane og indre vandveje) bliver omfattet af en enkelt retsakt.
Forslaget indeholder så vidt muligt ensartede bestemmelser for de tre transportformer og
ophæver forældede bestemmelser. Navnlig vil to direktiver vedrørende
sikkerhedsrådgivere for transport af farligt gods og fire beslutninger om nationale
undtagelser blive ophævet. Det vil føre til en brugervenlig, gennemsigtig tekst og reducere
omfanget af den gældende EU-ret med ca. 2 000 sider.
Revisionen af
legetøjsdirektivet
vil medføre en ajourføring af sikkerhedskravene og
forhindre skadelige virkninger på børn på mellemlang og lang sigt. Samtidig vil det indre
marked for legetøj komme til at fungere bedre. Hovedformålet med revisionen er at gøre
sikkerhedskravene til legetøj mere tidssvarende for så vidt angår legetøjs kemiske, fysiske
og mekaniske egenskaber. Der vil blive taget hensyn til de nyeste videnskabelige data for
at sikre, at kun sikkert legetøj er tilgængeligt på markedet i EU. Herudover vil den måde,
hvorpå direktivet håndhæves i medlemsstaterne, blive forbedret, og kravene til
medlemsstaterne om at foretage en passende og effektiv markedsovervågning vil blive
skærpet.
2.4.
Initiativer, som Kommissionen agter at forelægge på kort sigt (2008-2009)
Kommissionen vil intensivere sin indsats i de kommende to år. Det ajourførte program for
2008-2009 (bilag 1) består af 45 initiativer i 2008 og 9 i 2009. Eksempler på kommende
forenklingsinitiativer:
Ved
revisionen af de gældende bestemmelser om selskabsret, regnskaber og revision
vil en række administrative krav, der nu betragtes som forældede, urimelige eller
overlappende, blive ophævet eller begrænset. Hermed vil visse oplysningskrav i
direktiverne om selskabsret udgå, kravene til selskaber om offentlighed vil blive forenklet,
og medlemsstaterne vil kunne begrænse indberetnings- og revisionskravene til SMV'er
yderligere.
Ved
revisionen af den generelle gruppefritagelsesforordning
vil alle bestemmelser
vedrørende statsstøtte, som ikke skal anmeldes, blive samlet i et enkelt dokument, hvilket
vil reducere de administrative byrder for støttemodtagerne, medlemsstaterne og
Kommissionen. Den nye gruppefritagelsesforordning vil dække områder, som allerede er
omfattet af de eksisterende gruppefritagelser for uddannelse, beskæftigelse og SMV'er,
samt nye områder såsom miljø, risikokapital og regionalstøtte. Den vil også forbedre
SMV'ers adgang til statsstøtteprogrammer betydeligt, f.eks. vil den "SMV-bonus", der
kommer oven i den normale basisstøtte til investeringer og beskæftigelse, blive
harmoniseret og forhøjet fra 15 % til 20 % for små virksomheder og fra 7,5 % til 10 % for
mellemstore virksomheder.
Revisionen af Intrastat
- systemet til indsamling af data til statistikker over varehandelen
mellem medlemsstaterne - vil reducere virksomhedernes indberetningsbyrde.
Kommissionen vil på kort sigt foreslå at forenkle ordningen yderligere på traditionel vis
ved at reducere antallet af nomenklaturpositioner og forhøje tærskelværdierne for således
at fritage en lang række virksomheder. Det anslås, at indtil 190 000 virksomheder kan blive
fritaget for forpligtelsen til at indberette statistikker. Samtidig vil Kommissionen

Den kommende forordning om
avanceret sikkerhedsudstyr og dæk
skal træde i stedet
for omkring 50 særskilte direktiver. Det vil lette arbejdsbyrden betydeligt for
medlemsstaterne, som ikke længere vil skulle gennemføre EU-bestemmelser på dette
område. Herudover vil direkte henvisninger til UNECE-regulativer fremskynde
harmoniseringen af EU-retten med UNECE's bestemmelser og dermed gøre det muligt for
industrien at tilpasse sig den tekniske udvikling på internationalt plan hurtigere.
Revisionen af direktivet om
affald af elektrisk og elektronisk udstyr
(WEEE) og
direktivet om begrænsning af anvendelsen af visse farlige stoffer i elektrisk og elektronisk
udstyr vil præcisere begreber, lette gennemførelse og håndhævelse, mindske de
administrative omkostninger for producenter og myndigheder samt give de
erhvervsdrivende mere gennemsigtige ensartede spilleregler.
Forslaget til et rammedirektiv om
forbrugerrettigheder
skal indeholde fælles definitioner
og regulere de vigtigste rettigheder og retsmidler i forbindelse med forbrugeraftaler. Det
vil bidrage til at forbedre den måde, hvorpå det indre marked fungerer, og øge
forbrugertilliden ved at gøre regelværket enklere og klarere for virksomheder og
forbrugere.
Moderniseringen og omarbejdningen af kontrolordningen under
den fælles fiskeripolitik
vil
lempe kravene til sektoren og øge anvendelsen af it-værktøjer for at begrænse
indberetningskravene
.
Forenklingsinitiativer, som er specielt relevante for SMV'er, vil også blive fremhævet i "loven
om små virksomheder i Europa",
der skal iværksættes i 2008.
2.5.
Forenkling ud over det rullende program
Forenkling er mere end målrettede programmer såsom det rullende forenklingsprogram,
programmet til reduktion af administrative byrder og kodifikationsprogrammet. Det samme
krav om enkelhed skal anvendes på samtlige forslag til retsakter og operationelle procedurer.
For eksempel:
På forskningsområdet - der er et væsentligt element i Lissabonstrategien - er der også
blevet foreslået konkrete tiltag

med henblik på at forenkle
det syvende rammeprogram
for forskning, teknologisk udvikling og demonstration.
De administrative og finansielle
regler er således blevet ændret, og forvaltningen af rammeprogrammet og de enkelte
forskningsprojekter er blevet effektiviseret.
Kommissionen har foreslået at forenkle strukturen i
Erasmus Mundus-programmet
i
dettes anden fase (2009-13). Fællesskabets indsats på området videregående uddannelser i
forbindelse med tredjelande vil blive mere sammenhængende, idet der vil ske en
strømlining af en lang række eksisterende programmer, som i øjeblikket forvaltes efter
forskellige regler, selv om de i alt væsentligt dækker de samme områder. Der vil herved
blive oprettet en kvikskranke for interesserede parter, der deltager i akademisk samarbejde
med tredjelande og i international mobilitet.

Intrastat-statistikkerne udarbejdes i øjeblikket efter et system, hvor hvert land indberetter både import-
og eksportstrømme. Alle strømme indberettes således to gange.

Kommissionen har ajourført og erstattet fire forskellige meddelelser om forskellige
kompetencespørgsmål med en enkelt
konsolideret meddelelse om jurisdiktion
under EF-
fusionsforordningen. Den førte til øjeblikkelig forenkling af den administrative vejledning
og praksis.
Indførelsen af "elektroniske
logbøger" inden for fiskeri
har betydet, at indberetningen af
fangstdata er blevet helt papirløs for både fiskere og de nationale myndigheder.
De nye forordninger om samhørighedspolitikken i perioden 2007-2013 har mindsket
antallet af fonde og programmeringsfaser og forenklet den finansielle forvaltning, hvilket
har givet de lokale myndigheder, der forvalter programmerne i praksis, større råderum.
Bestemmelserne om Samhørighedsfonden og strukturfondene er blevet harmoniseret,
således at de lokale myndigheder og støttemodtagerne kun skal anvende et enkelt sæt
regler til ansøgning om midler fra de to typer fonde. I samme ånd er en enkelt ny
kommissionsforordning om gennemførelse af strukturfondene trådt i stedet for ti
gennemførelsesforordninger.
Herudover er gennemførelsen af det indre marked fortsat et af de mest effektive midler til at
forbedre erhvervsklimaet. I de ti år, der fulgte efter gennemførelsen af lovpakken om det indre
marked i 1993, steg EU's BNP med hele 223 mia. EUR, svarende til 2,2 %, som følge af
fjernelsen af hindringer mellem medlemsstaterne. Det beløber sig til 1 450 EUR ekstra
indkomst pr. husstand. Desuden voksede beskæftigelsen med 1,4 %, svarende til 2,75 mio.
ekstra job. Et enkelt sæt EU-bestemmelser betyder, at virksomhederne ikke behøver at sætte
sig ind i 27 forskellige sæt nationale bestemmelser, tilpasse deres varer og tjenesteydelser og
derefter påvise, at de opfylder de pågældende bestemmelser. For eksempel:
Kommissionen har for nylig fremsat et forslag om ændring af EF-
køretøjstypegodkendelser
ved at indføre harmoniserede regler for brintdrevne
motorkøretøjer, således at fabrikanterne kan udnytte stordriftsfordelene ved store
produktionsserier til hele det europæiske marked, og forbrugerne i EU får sikkerhed for, at
disse innovative køretøjer lever op til høje standarder for sikkerhed og miljøbeskyttelse.
Tilpasningen af typegodkendelsesystemet til fremtidens teknologier vil også sætte EU's
bilindustri i stand til at holde trit med dens vigtigste konkurrenter på globalt plan og
forbedre dens konkurrenceevne på tredjelandsmarkeder.
I december 2007 fremsatte Kommissionen et forslag til et nyt direktiv til fjernelse af
hindringer for
handel med forsvarsprodukter inden for Fællesskabet.
Handelen med
disse produkter i det indre marked har indtil i dag været underlagt en lang række
forskelligartede nationale procedurer, som ikke alene medfører en betydelig administrativ
byrde for virksomheder og offentlige myndigheder, der påfører dem udgifter på over 430
mio. EUR om året, men også lange leveringsfrister på op til flere måneder. Denne byrde er
tydeligt ude af proportion med de faktiske kontrolbehov, som det fremgår af det forhold, at
selv om der hvert år udstedes ca. 11 500 licenser for overførsel inden for Fællesskabet,
blev der i hele perioden 2004-2006 kun givet afslag på tre ansøgninger. Forslaget vil gøre
EU's forsvarsindustri økonomisk og teknologisk mere konkurrencedygtig, forbedre
SMV'ers forudsætninger for at deltage i udvikling og produktion af forsvarsmateriel, sætte
medlemsstaterne i stand til at opfylde deres behov på det militære område under korrekte
sikkerhedsforhold og til lavere omkostninger samt forbedre forsyningssikkerheden i
forbindelse med offentlige kontrakter og industrielt samarbejde.
2.6.
Kommunikationsredskaber og høring af interesserede parter
For at give forenklingsprogrammet fremdrift er det meget vigtigt med klare og gennemsigtige
oplysninger om de fremskridt, der sker med dets gennemførelse. Med henblik herpå har

, der har til formål at stille generelle
oplysninger om forenklingsstrategien til rådighed og give interesserede parter mulighed for at
følge med i, hvordan det rullende program skrider frem. I en række andre sektorer (f.eks.
landbrug) er der desuden gjort en indsats for at lette samråd med medlemsstaternes
sektoreksperter og interesserede parter gennem sektorgrupper.
I overensstemmelse med sin hensigt om lade forenklingen tage udgangspunkt i de
interesserede parters praktiske erfaringer oprettede Kommissionen i efteråret 2007 et nyt
websted for onlinehøringer for at indhente virksomhedernes overvejelser og forslag
vedrørende de byrder, der følger med lovgivningen og bureaukrati generelt. Kommissionen
vil udnytte de interesserede parters input så godt som muligt. Det skal primært anvendes i
forbindelse med "handlingsprogrammet for reduktion af administrative byrder i Den
Europæiske Union", men eventuelle bidrag vedrørende mere generelle emner af relevans for
indholdet af lovgivningen, vil blive taget i betragtning ved udformningen af
forenklingsstrategien.

ODIFIKATIONSPROGRAMMET
Kodifikation

er en vigtig del af Kommissionens indsats for at reducere omfanget af den
gældende EU-ret og gøre den mere tilgængelig.
Kodifikationsprogrammet omfatter ca. 400 kodifikationsretsakter, hvoraf størsteparten er
lovgivningsmæssige forslag. I alt 87 retsakter er blevet kodificeret og vedtaget og
offentliggjort i EUT (62 kommissionsretsakter og 25 retsakter udstedt af Europa-Parlamentet
og Rådet). Disse 87 retsakter træder i stedet for 348 tidligere retsakter. Herudover er
65 retsakter til behandling hos den lovgivende myndighed, og 4 retsakter vil meget snart blive
vedtaget af Kommissionen. 152 kodifikationsretsakter er således allerede blevet
færdigbehandlet af Kommissionen.
For at afslutte kodifikationsprogrammet inden udgangen af 2008 (bilag 2) er der truffet
foranstaltninger til at indhente efterslæbet ved oversættelsen af de tekster, der skal kodificeres
på de nye EU-sprog. Den lovgivende myndigheds vedtagelse af kodificerede retsakter er
underlagt bestemmelserne i den interinstitutionelle aftale om en hurtig arbejdsmetode ved
officiel kodifikation af lovtekster af 20. december 1994.

4.1.
I
NTERINSTITUTIONELLE ASPEKTER
Forslag, der er til behandling hos den lovgivende myndighed
Ansvaret for en vellykket forenkling påhviler alle, der deltager i beslutningsprocessen. I 2007
lykkedes det den lovgivende myndighed at færdigbehandle de resterende forslag fra
forenklingsprogrammet for 2003-2004.
Imidlertid er 44 forslag i det rullende program for 2005-2009 stadig til behandling hos den
lovgivende myndighed (bilag 3). Når det drejer sig om direktiver, skal EU's bestemmelser
efterfølgende gennemføres i national ret. Det betyder, at der kan gå adskillige år, inden
fordelene ved forenklingen kommer borgere og virksomheder til gavn (og inden de
overhovedet bliver bekendt med dem).
Kommissionen har derfor opfordret de øvrige institutioner til at vedtage dens
forenklingsforslag hurtigst muligt.

4.2.
Forenkling og de øvrige institutioner
Rådet (konkurrenceevne) overvåger som led i Lissabonstrategien for vækst og beskæftigelse
gennemførelsen af dagsordenen for bedre lovgivning og udarbejder en statusrapport ved
slutningen af hvert formandskab, som bl.a. gør rede for fremskridt med det rullende
forenklingsprogram. Kommissionen glæder sig over Rådets fortsatte interesse for bedre
lovgivning i almindelighed og forenkling i særdeleshed, men bemærker, at Rådets
arbejdsmetoder i forbindelse med gennemgangen af forenklingsforslag endnu ikke har ændret
sig grundlæggende til trods for de tilsagn, der er givet i den interinstitutionelle aftale om bedre
lovgivning.
I sin beslutning om en strategi til forenkling af de lovgivningsmæssige rammer

Europa-Parlamentet Kommissionens kodifikationsprogram velkomment og erklærede sig enig
i, at forenklingsprogrammet bør fremmes og støttes af tilsvarende nationale
forenklingsinitiativer. Parlamentet opfordrer også de tre institutioner til at indgå en
interinstitutionel aftale om en hurtig arbejdsmetode i forbindelse med forenklingstiltag.
Kommissionen værdsætter Parlamentets konstruktive støtte og de tiltag, der allerede er truffet
for at gennemføre dagsordenen for bedre lovgivning. Kommissionen glæder sig i særdeleshed
over, at Parlamentet har ændret sine interne procedurer for behandling af forslag til
kodifikation og omarbejdning, således at ansvarsfordelingen mellem de forskellige udvalg er
blevet præciseret, og at der ikke unødigt foretages indholdsmæssige ændringer af kodificerede
dele.
Kommissionen opfordrer derfor Rådet og Europa-Parlamentet til at sørge for hurtig
vedtagelse af de forslag, der stadig er til behandling, og sikre, at forenklingsaspekterne
bibeholdes under proceduren.
4.3.
Samarbejde med det Europæiske Økonomiske og Sociale Udvalg og
Regionsudvalget
Kommissionen har forsøgt at forbedre tilrettelæggelsen af undersøgelserne blandt
civilsamfundsorganisationerne vedrørende den gældende EU-rets kvalitet.
På foranledning af Kommissionen afgav EØSU i september 2007 en udtalelse om
mulighederne for forenkling af de lovgivningsmæssige rammer for maskinsektoren. Den
skulle omfatte både sektorspecifikke bestemmelser og lovgivningen vedrørende maskiner
generelt, herunder sundhed, sikkerhed og miljøbeskyttelse. Kommissionen agter at fortsætte
dette samarbejde og har nu anmodet EØSU om yderligere rapporter vedrørende andre
nøglesektorer som f.eks. byggesektoren og forretningsservice.

ONKLUSIONER OG AFSLUTTENDE BEMÆRKNINGER
En reduktion af bureaukratiet er nu et vigtigt punkt på Fællesskabets politiske dagsorden.
Ligesom de øvrige elementer i dagsordenen for bedre lovgivning, som Kommissionen
udarbejdede i begyndelsen af sin mandatperiode, afvikles forenklingsstrategien nu i det
planlagte tempo og leverer i øjeblikket de første konkrete imponerende resultater.
Kommissionen vil færdiggøre sin screening af ca. 95 000 sider af den gældende EU-ret for at

pege på mulige målområder for den fremtidige forenklingsindsats. Den agter at indarbejde
resultaterne i det ajourførte rullende forenklingsprogram, der skal forelægges i starten af
2009. Kommissionen er fast besluttet på at gennemføre det nuværende rullende program fuldt
ud og gøre den gældende EU-ret så enkel, trimmet og ajourført som muligt. En metode er
blevet taget i brug, og indsatsen giver resultater.
Det er imidlertid klart, at de lovgivningsmæssige rammer ikke kan forbedres af
Kommissionen alene. Mere end nogensinde er det vigtigt med et ægte, samordnet og fast
engagement på alle lovgivningsniveauer for at omsætte politiske hensigtserklæringer til
konkrete resultater og sikre, at virksomheders og borgeres reelle forventninger imødekommes.
Europa-Parlamentet og Rådet har et fælles institutionelt ansvar for, at Kommissionens forslag
når den endelige vedtagelsesfase. Indtil nu og til trods for de bestræbelser, der ubestrideligt er
gjort, er mindre end en fjerdedel af alle de forenklingsforslag, som Kommissionen har
forelagt, og som skal vedtages af den lovgivende myndighed, blevet vedtaget. Det er
naturligvis meget vigtigt, at disse forslags forenklingsaspekter bibeholdes under
beslutningsproceduren.
På samme måde bør de nationale, regionale og lokale myndigheder med ansvar for
gennemførelsen af EU-lovgivningen bestræbe sig på at videreføre det arbejde, der gøres i
Bruxelles. Det sker for ofte, at sen gennemførelse eller overregulering undergraver EU-
bestemmelsernes forenklingseffekt. Det igangværende arbejde med at kortlægge og måle
administrative byrder på visse politikområder forventes at føre til interessante oplysninger
herom. I overensstemmelse med den nyligt offentliggjorte meddelelse "Et resultatorienteret
Europa – anvendelse af fællesskabsretten" agter Kommissionen at forstærke sin indsats for at
forebygge overtrædelser af EU-retten ved at forbedre kvaliteten af den bistand, den tilbyder
medlemsstaterne med henblik på at lette korrekt gennemførelse og anvendelse af direktiverne.
Eftersom størsteparten af EU-regelværket ikke udformes på fællesskabsplan, skal der endelig
også udvikles forenklingsprogrammer på nationalt (og når det er relevant, regionalt) plan - og
sådanne programmer skal styrkes - for at tackle det omfattende bureaukrati, der breder sig
uafhængigt af EU-lovgivningen. I fremtiden vil Kommissionen lægge vægt på dette aspekt,
når den gennemgår de nationale reformprogrammer, der forelægges som led i
Lissabondagsordenen.

1. Legislative proposals arising from the Communication on Revision
the 'Health Check' in the Common Agricultural Policy
Following the 2007 Communication on the "Health Check" in the
Common Agricultural Policy (CAP), the legislative proposals will
provide options aiming at making the Single Payment Scheme more
effective, adapting the market support instruments and addressing the
new challenges facing the sector. The "Health Check" is not a
fundamental reform, rather it essentially aims to ensure that the CAP
functions effectively and to simplify it where possible. This initiative
arises from the review clauses regarding the Single Payment Scheme
and certain agricultural markets that were included in the 2003/04 CAP
reforms.
This initiative has as objective to establish the conditions regarding co-
financing of information and promotion programmes for agricultural
products in the internal market and in third countries. It will take the
form of a consolidation of two existing Commission Regulations ((EC)
No 1071/2005 and (EC) No 1346/2005).

3. Private Storage: Commission Regulation laying down Revision
common rules for private storage of agricultural products
under Common Agricultural Policy
The aim of the proposal is to replace multiple sectoral rules by
horizontal ones and to simplify management mechanisms relating to the
private storage of agricultural products. Existing sectoral provisions,
which may vary from one sector to another, will be examined with a
view to eliminating unnecessary provisions and to harmonising the
system of private storage.
The single common market organisation (CMO) regulation, scheduled
for adoption by Council in October 2007, merges existing CMOs into a
single text. It does not modify policy but streamlines and harmonises
legislation. Various substantive amendments were made in the
meantime to the existing CMOs. This is notably the case in the milk,
the sugar and the fruit and vegetables sectors, It is important to
incorporate these amendments into the single CMO in order to achieve
the aim of having one single simplified legal text which will facilitate
the access to the existing legislation and thus create a much higher
degree of transparency and legal clarity. The initiative thus concerns
the subsequent Commission proposal.
The purpose of the initiative is to simplify the procedures relating to
intervention buying of butter, to abolish national butter quality grades,
and to abolition private storage aid for cream and skimmed milk
powder. Technical clarifications and simplification (e.g. concerning the
security provisions) will improve the readability of the text.

6. Streamline Controls: Amendment of Commission Revision
Regulation (EC) No 796/2004 regarding the detailed rules

This proposal stems directly from the Commission report to the
Council on the application of the system of cross-compliance
(COM(2007) 147). Its amendments will lead to simpler and more

The final objective pursued by the Commission is to group all existing
Block Exemption Regulations into one single Regulation for the first
time ever. This will bring a qualitative impact in terms of clarity,
predictability and transparency of EU rules for business and national
and regional authorities. The new GBER will cover areas already
covered by block exemptions (training, employment, SME) and new
areas (environment, risk capital, regional aid). Texts on research and
capital risk were adopted in 2006, but those applicable to the
environment will be adopted in 2007. Finalisation of the draft new
GBER is scheduled for 2007 and formal adoption by the Commission
in 2008.
Directive 2001/23/EC does not contain any provisions on conflict of
laws. As a result, there is a lack of clarity as to how to apply the
provisions of the Directive to cross-border transfers. The aim of the
proposal - to be made by the Commission following the two phases of
consultation of social partners - is therefore to clarify the application of
the Directive to cross-border operations. The proposal would increase
legal certainty for economic and judicial agents and result in costs
savings for undertakings and better protection for workers.

13. Community initiative on work-related musculoskeletal Recast
disorders
The objective of this initiative is to integrate into a single legislative
instrument the provisions on the protection of the health and safety of
workers from the risks of musculo-skeletal disorders at work. These
provisions are currently fragmented over different directives, namely
Council Directive 90/269/EEC on the minimum health and safety
requirements for the manual handling of loads and Council Directive
90/270/EEC on the minimum health and safety requirements for work
with display screen equipment. A single legislative instrument would
be more comprehensive, clearer and easier to apply. It will benefit
employers in terms of legal clarity and workers in terms of providing
better protection against the risks of musculo-skeletal disorders.
The objective is to simplify the rules concerning post-licensing changes
to medicines (so-called ‘Variations’ Regulations). Administrative
management of these rules currently mobilise more than 60% of the
human resources and financial costs of companies’ regulatory
departments. In some cases, this burden may hinder innovation by
preventing the introduction of changes that are beneficial to patients
and society. The objective of this initiative is to reduce the
administrative burden for industry by streamlining the circumstances
obliging industry to fill applications for variations of human and

rules on changes to the marketing authorisation doesn't allow the
Commission to set rules for purely national marketing authorisation.
This legal basis should be widened to close the gap for harmonisation.
This initiative aims at changing the legal basis for Directives:

15. Revision of the pharmaceutical "Variations" Regulations: Revision

The objective is to reduce the administrative burden for industry by
simplifying the rules for variations of human and veterinary medicinal
products. The Variations regulation are implementing rules adopted by
the Commission on changes to the marketing authorisation of
pharmaceuticals.
The proposal will simplify EC legislation in the domain of vehicle
safety by replacing existing legislation in the area into one main
Regulation. It will include electronic stability control and low rolling
resistance tyres. The proposal will repeal some 50 separate Directives
and will replace them, where appropriate, with references to UNECE
Regulations. The beneficiaries of the simplification aspect of this
proposal will primarily be vehicle manufacturers and national approval
authorities. Replacing Directives with a Regulation will also ease the
administrative burden on the Member States since they would not have
to transpose legal acts in the domain of vehicle safety in the future.
Furthermore, references to UNECE Regulations will avoid the existing
duplication between EU and UNECE law and will thus lead to "better
regulation".

17. Textiles: simplification and replacement by a single Revision
regulation
The replacement of 3 Directives by 1 Regulation will simplify
procedures for Member States, companies and the Commission leading
to shorter periods for adoption of new fibre names. The standard
methods of quantitative analysis of binary and ternary textile fibre
mixtures currently included in two of the directives are to be transferred
to the standardisation process. This means that consumers and
companies could benefit faster from the use of new innovative
products. Innovation and technological developments will be thus
encouraged. In addition, the legal nature of the legislation (Regulation)
will facilitate the application of technical adaptations by the Member
States.
The objective is to repeal 4 Directives on Pressure Vessels
(76/767/EEC, 84/525/EEC, 84/526/EEC, 84/527/EEC) and integration
of the still relevant provisions into the revision of Directive 99/36/EC
(Transportable Pressure Equipment).
The objective is to provide for a coherent legal framework for legal
metrology. The extension of the scope of the Directive is the legal
prerequisite for the repeal of the following "old approach" Directives.
The revision aims at improving environmental performance of the
organisations participating and increasing participation from both
industrial and public sector. Legal compliance and environmental
performance improvement of the participating organisations will be
facilitated by providing access to advice on environmental legal

The revision aims at enhancing effectiveness and market impact by
increasing the range of eligible product groups and the number of eco-
labelled goods and services actually available to the consumer. For this
purpose, the procedure of developing and adopting eco-label criteria
will be thoroughly changed and simplified. Economic stakeholders will
be involved to a greater extent into the process, thereby increasing
ownership and self-regulatory aspects of the scheme, whereas the
administrative burden put on Member States will be reduced. Once the
criteria are adopted, it will be easy for economic operators to apply for
the award of the eco-label to their products. Synergies with existing
eco-labels at national level will be facilitated and limits will be put on
the costs and fees Member States' authorities may charge on the
applicant. Furthermore, the criteria should be defined in such a way that
they can be easily used for the purpose of green public procurement.

22. Biocides: revision of the legislation on the placing of Recast
biocidal products on the market
This proposal follows the 2007 Report on the implementation of the
Biocides Directive (98/8/EC). The objective is to provide a revised
legal framework for regulating the placing on the market of biocidal
products. The revision aims to address concerns regarding complexity
and the cost, as well as the availability of certain biocidal products, and
bring about a significant simplification of the current legislative
framework and procedures. The revision of the biocides legislative
framework will bring it in line with the EU Chemicals policy (REACH
Regulation).
The revision of the Directive 2002/96/EC will examine possibilities to
increase the efficiency and effectiveness of the directive in achieving
its environmental goals and eliminate any unnecessary costs to
business, consumers, NGOs and public authorities arising from
implementation of the directive. The revision will concern the targets,
scope, treatment requirement and the operation of the producer
responsibility provisions.
The revision aims at clarifying concepts and facilitate the
implementation and enforcement while increasing the environmental
benefits. It will enhance legal certainty for all stakeholders and will
facilitate implementation by manufacturers by streamlining the
mechanism for granting exemptions and enforcement by national
authorities through market surveillance and administrative cooperation
clauses. It will furthermore provide a more transparent level playing
field for manufacturers and simplify procedures through introduction of
harmonised compliance checking. Most of these measures will also
enhance the internal market effect of the Directive and reduce

25. Ozone layer: revision of Regulation (EC) No 2037/2000 on Recast
substances that deplete the ozone layer
As the production and consumption of the substances covered have
been reduced or phased out, many provisions of the Regulation, after
seven years in force, need to be repealed or updated. Other provisions
may benefit from simplification such as clarification of definitions and
procedures and interaction with other pieces of legislation. This will
reduce the cases of ambiguous interpretation and the risk of
infringements and consequent administrative burdens. In particular,
most of the administrative cost reduction will result from ending
exemption provisions on some uses of ozone depleting substances. The
beneficiaries will be the Member States and the Commission. Overall,
the cost savings from ending the exemptions is expected to exceed any
additional cost associated with new control measures to combat illegal
trade of ozone depleting substances.
Following the 2007 Communication the Commission will adopt
legislative proposals underpinning the development of SEIS that could
address reporting streamlining and/or coherence of approaches to
monitoring and information. This initiative aims to improve the
availability, quality and comparability of data, avoid redundancies in
reporting requirements to Member States and therefore, the
administrative burden, remove obstacles related to information
accessibility and enhance the coherence of monitoring systems and

33. Proposal for a Framework Directive on Consumer Revision
Contractual Rights
The overall aim of the revision of the acquis, is to simplify and improve
the coherence of the consumer regulatory framework and thus enhance
legal certainty both for consumers and business. The legal instrument
will be a combination of codification and repeal of parts of existing
directives and enactment of new rules. The revision will be based on a
mixed approach consisting of the adoption of a horizontal instrument,
underpinned whenever required by vertical revisions of existing
directives. This framework instrument would systematise and regulate
in a uniform fashion common features of the consumer acquis. The
instrument would provide common definitions and regulate the main
consumer contractual rights and remedies. It would also regulate
consistently the contractual aspects of sales which are currently
scattered across several Directives.
34. Simplify procedures of listing and publishing information Revision
in the veterinary and zootechnical fields
The general objective is to harmonise and simplify, essentially by
means of electronic tools, the current procedures for listing, updating
and publishing information in the veterinary and zootechnical fields
such as lists of approved animal health establishments and breeding
organisations in Member States and Third Countries and lists of certain
national reference laboratories. 22 Council acts are concerned.
The main objective of this proposal will concern the transfer and up-
date by comitology of the list of MRLs (Annex II) and temporary
MRLs (Annex III) based on European Food Safety Agency (EFSA)
assessment and mathematical models/expert calculations. The proposal
will be a final step towards harmonisation of divergent national MRLs.

36. Review of the provisions related to the total feed ban
Revision
A ban on the feeding of mammalian meat and bone meal (MBM) to
cattle, sheep and goats was introduced as of July 1994. This partial ban
was extended to a total EU wide suspension on the use of processed
animal protein in feed for any animals farmed for the production of
food on 1 January 2001 with some exceptions like the use of fish meal
for non-ruminants. Any presence of prohibited constituents of animal
origin in feed is considered as a breach of the feed ban i.e. the zero-
tolerance.
Following the adoption of the TSE Road map the Commission issued a
Commission staff working paper i.e. Work Programme on TSE
[SEC(2006) 1527] on future legislative actions in the field of
transmissible spongiform encephalopathy. One of the topics concerns a
revision of the feed ban provisions. The starting point when revising
the current feed ban provisions should be risk-based but at the same
time taking into account the control tools in place to evaluate and
ensure the proper implementation of this feed ban.

protection against the dangers arising from exposure to
ionising radiation
The revision of the safety provisions will consist of:
- Completion of the equivalence determination between the Swiss
legislation related to food safety and veterinary policies including
border veterinary controls and import conditions, updating of the
content of the Agreement with regard to legislations adopted since the
last Agreement modification.
- As Switzerland has accepted to apply the EC acquis in relation to
animal health, food safety and hygiene controls, a uniform high level of
protection will therefore exist in the EC and Switzerland. This permits
the abolition of border controls on trade in animals and animal products
between the two.
Recast into a single Council Directive of relevant Euratom acts on
radiation protection including a substantial revision of the Basic Safety
Standards (BSS) directive. The objective is to bring the BSS directive
in line with the forthcoming recommendations of the International
Commission on Radiological protection (ICRP), when available. At the
same time the legislation in the field of radiation protection has to be
simplified.
The current system of emergency oil stocks shows limitations and
shortcomings on several accounts. The provisions of the existing
legislation will be revised in order to create a system for coping with oil
supply disruptions. The new proposal will replace existing Directives
and contribute to simplification of EU legislation.

40. Recasting of Directive 2002/91/EC of 16 December 2002 Recast or
on the Energy Performance of Buildings
Revision
The Energy Performance of Buildings Directive makes certificates for
the energy performance of buildings mandatory when buildings are
constructed, sold or rented out and requires minimum energy
performance requirements for new buildings and existing building
which undergo major renovation. Furthermore, the Directive requires
regular inspections of boilers and air-conditioning systems in order to
guarantee their energy efficient operation. An amended Directive could
enlarge the scope to more buildings, strengthen and specify some of
these requirements and add, for instance, financing aspects. The
changes under consideration aim at overcoming multiple barriers that
hinder the utilization of the vast potential for energy demand reductions
in the buildings sector. The recasting of the Directive is part of package
on the Strategic Energy Review and included in the Energy Efficiency
Action Plan. The amendments will cover some articles of the Directive
and add new ones. The "simplification" will consist of using the
"recasting" technique to facilitate reading and comprehension for the
implementing authorities and for the many stakeholders affected.
Amend the existing framework Directive to enlarge its scope (beyond
domestic appliances) and update for modern communication tools (e.g.
internet) to enhance public/consumer awareness on efficient products.
The simplification will be obtained by using the recasting technique for
consolidating the original Directive with its amendment in one single
document.

42. Proposal to recast the legislation concerning the "first Recast
railway package" following the report in 2006 of its
implementation, in particular for the requirements

The first and successive railway packages are legal instruments to
achieve the Community's objective to create a European Railway Area
through market opening, as well as technical and regulatory market
integration. As rail markets transform, an ongoing review of the
suitability of the EU legal framework appears appropriate with possible
simplification and streamlining. The Commission intends to present a
communication accompanied by a proposal for modification/recast of
the existing acts, especially Directives 91/440/EEC and 2001/14/EC.
The political goal is to enhance the competitiveness of rail transport in
Europe and to hence contribute to achieving the objectives of the
Lisbon strategy. The recast aims at a simplification of the text of the
three Directives of the 1st railway package by merging them into one
legal act, a 'railway access code'. By eliminating existing cross-
references between the Directives the reading and implementation will
be come easier for the implementing authorities and the many
stakeholders affected.
The older directive needs to be modernised following the establishment
of EASA and following the advice of the Group of Experts established
by EC Decision 2003/425/EC. In addition the newer directive needs to
be built on to create a minimum set of centralised functions, including a
database to allow appropriate entities to carry out trend analysis or
other studies, and keep track of safety recommendations, while
providing information to the general public. Both directives will be
replaced by a single piece of legislation. The objective of the
simplification is to take advantage of the necessary revision of the
Directive 94/56 to adapt it to recent developments by merging it with
Directive 2003/42/EC to create a single legislative act as both

The objective is to modernise and reform the existing system
established by Council Directive 96/98/EC on marine equipment. Its
main objectives are: 1) to produce a consolidated version of the text
following the successive amendments of the Directive 2) to improve
the functioning of the Directive's system by addressing the existing
shortcomings ; 3) to adapt it to the reform of the New Approach. It is
intended to abrogate the existing Directive and replace it with an
entirely new one, while recourse to recast is not excluded. At present,
the Directive needs periodic amendments in order to keep pace with the
safety requirements and technical standards produced by the
International Maritime Organisation as well as the international and
European standardisation bodies. This produces an inevitable mismatch
between the European and international regulatory frameworks,
sometimes spanning several years, whose correction will greatly
facilitate the work of the sectors concerned and thus favour the
competitiveness of the European marine equipment industry.
