Dear Mrs. Valerie Tankink,
I contact you as the CEO of the Danish Pelagic Producers Organisation with a request for the Commissions legal opinion on
legislation on fish quota allocation recently proposed in Denmark and currently in a national hearing phase. The proposd
changes to existing fisheries legislation can be found through the link below (in danish). In short, the proposed legislation,
if passed, would allow the Ministry of Foreign Affairs (fisheries) to allocate fishing opportunities through auctions, thus
generating general public funds. My question to the DG Mare Legal Services is weather allocation of fishing opportunities
through auction is in line with criteria for allocation set in articles 16 and 17 of the Common Fisheries Policy? And whether
Denmark with the proposed legislation is in breech of EU legislation? The presented legal material from the Danish
Minihstry of Foreign Affairs does not include a legal analysis relating to EU legislation.
